FEB 20 '98 1O:5OAM TOWN OF WESTPORT P.6/13 <br /> 5. Contracts entered into by the Town and Developer for all public <br /> improvements shall be reviewed and approved by the Town Attorney and Town <br /> Engineer. <br /> 6. A Development Agreement between the Town and Developer, in a form <br /> acceptable to the Town Attorney, shall be executed requiring the Developer to pay <br /> Town Engineer and Town Attorney review fees. Fees for any and all reviews are to <br /> be paid to the Town prior to the Town's plat approval signature. <br /> 7. A letter of credit for contemplated road, sewer, water, stormwater <br /> detention/retention, and other required public improvements shall be required in <br /> amounts approved by the Town Engineer and in a form approved by the Town <br /> Attorney. <br /> 8. Based on the Plan Commission's findings that: (a) there is no land <br /> reasonably available or suitable for parks within the property due to its size and <br /> location; (b) that dedication of land for park purposes would not be compatible with <br /> the Town Land Use Plan or any Town park plan since no park is planned for this <br /> property; and (c) that a cash contribution would better serve the public interest, on <br /> which such findings the Board agrees, the Town shall accept parkland dedication fees <br /> in satisfaction of the Town's parkland dedication requirements based on the number of <br /> units in the Plat (44), in accordance with section 10-2-84 of the Town Code. <br /> 9, The Town Attorney shall review and approve all deed restrictions and <br /> condominium rules and by-laws proposed by the Developer prior to the Clerk's <br /> x,\WIP\a006\154\CONRES2.TOW <br /> 0217981124 4 <br />
