13. LANDSCAPING: <br /> The following minium landscaping requirements shall apply to <br /> all lots within sixty days of completion of construction of <br /> the residential dwelling constructed on the premises: <br /> (a) At least two street trees (4 on corner lots) shall be <br /> planted by the lot owner within the front setback area. The tree <br /> variety shall be subject to approval of the Architectural Control <br /> Committee. <br /> (b) At least three conifers with a minimum size of 4 feet <br /> shall be planted in the front yard for each dwelling to be selected <br /> from any of the following varieties - Colorado Green, Blue Spruce, <br /> Black Hills Spruce, Austrian Pine or Douglas Fir. <br /> (c) No existing trees on any lot shall be cut down without <br /> prior approval of the Architectural Control Committee. This <br /> restriction shall not apply to trees required to be removed from <br /> the dwelling site as approved by the Architectural Control Committee. <br /> (d) The requirements set forth by the Ferry Bluff Eagle Council <br /> must be followed. <br /> 14. ARCHITECUTRAL CONTRAL COMMITTEE: <br /> Initially and so long as La Verne J Reible and Bonita S Reible <br /> have any interest in any lot within the Eagle Terrace Subdivision, <br /> they shall be sole members of the committee, however, additional <br /> land owners may be added. In the event of the 'death or resignation <br /> of one or both members, the Architectural Control Committee shall <br /> consist of three owners of lots within the subdivision elected by <br /> the majority of then owners of lots within the subdivision with <br /> each lot entitled to one vote. Sucessor members in the event of <br /> death or resignation shall be selected by the remaining or surviving <br /> members of the committee. <br /> A copy of the plans, specifications and site plan shall be <br /> submitted to the committee prior to commencment of construction. <br /> In the event a plan is submitted to the committee and approval or <br /> rejection is not received within 30 days from submission, written <br /> approval shall not be required, EXCEPT, however the dwelling and <br /> its location shall, in any event, conform to all minimum require- <br /> ments set forth in the Declaration. In addition, all plans must <br /> meet Local and County ordinances. <br /> 15. COMMENCEMENT OF CONSTRUCTION: <br /> On any lot conveyed by deed from the developer, construction <br /> shall be commenced within 18 months from the date of such deed. <br /> Upon violation of .this restriction, the developer shall have the <br /> option to repurchase said lot at the original sale price, <br /> without further adjustment or allowance. <br /> -5- <br />
