I've dealt with Mr. Thompson before and he had some good <br /> ideas concerning the berm and barriers at the shooting stands which we plan to unilaterally <br /> incorporate into the range. Some diagrams by Greg Denner are included herein. <br /> Ms. Long also mentions the fact that the Definer's did not object to the Goldschmits <br /> rezoning the adjoining lots. That is true, and that is because the realtor, Allison Goldschmit, <br /> specifically stated at the hearing that there was no problem with the neighboring range. <br /> Presumably, if Ms. Goldschmit and Mr. Waters felt the range diminished the value of the lot <br /> it was reflected in the price Mr. Waters paid for the lot, and he has no claim for diminished <br /> property values. He bought the lot on October 29th, approximately three weeks after he <br /> complained about the range to Dane County Zoning. He obviously knew it was there before he <br /> bought it, and if he thought it was not in use he was given misinformation by the seller. If there <br /> was indeed a misrepresentation by the seller -- and I don't know if that's true -- I would suggest <br /> that the issue is a matter to be resolved between the buyer and the seller. <br /> The situation has not "dramatically changed" with the construction of a nearby home, as <br /> Ms. Long alleges, because there was a homestead on the same site for many years prior to the <br /> approval of the subdivision. Eleven children were raised on the same piece of property, and you <br /> heard the testimony of one of them on February 13. <br /> Mr. Waters also submitted various photos of the range with attached notes. We strongly <br /> dispute Mr. Water's assertion that raising the rifle 1/4 of an inch will cause it to shoot over the <br /> berm at 200 yards. You will note that this is not in Mr. Thompson's report but only in a <br /> statement by Mr. Waters. Our calculations show about 6 times the variance alleged by Mr. <br /> Waters and Mr. Salkin can explain what he saw in our shooting demonstration at the range, such <br /> as the use of the "V" shaped brace for the firearm. Again, 95% of the shooting is at 100 yards <br /> or less. Mr. Waters also makes reference to tires on the top row with lead shot in them. Tires <br /> from below have routinely been moved to the top of the berm. All of the above issues were <br /> raised and discussed at the Town hearing last Thursday. <br /> Mr. Waters is also incorrect in his assertions contained in the map he submitted alleging <br /> that other property owners were also against our petition. His information is dated and these <br /> owners did initially question the petition after hearing only Mr. Waters side of the story. After <br /> hearing our side of the story, Wingra Stone representatives said they were not opposed to it and <br /> if they changed their mind they would appear at the hearing. They did not appear. A member <br /> of the KMRZ partnership, Mr. Ripp, also stated they were no longer opposed after hearing our <br /> story. The same holds true for Scott Justo, who owns two of the other lots next to Mr. Waters. <br />
