• <br /> • <br /> STATE OF WISCONSIN <br /> LAND AND WATER CONSERVATION BOARD <br /> DANE COUNTY AGRICULTURAL DOCKET NO. <br /> PRESERVATION PLAN AMENDMENT; DECISION CERTIFYING THE PLAN <br /> TOWN OF OREGON TEXT AND MAP UNTIL DECEMBER 31, 2005, WITH <br /> CONDITIONS <br /> INTRODUCTION <br /> Pursuant to ss. 91.06 and 91.61, Wis. Stats., Dane County asks the State of Wisconsin Land <br /> and Water Conservation Board (LWCB) to certify an amendment to the county's agricultural <br /> preservation plan. The amendment changes the plan text and map for the Town of Oregon in <br /> Dane County. The LWCB considered this matter on December 4, 1996, and adopted the <br /> following decision: <br /> FINDINGS OF FACT <br /> (1) The State of Wisconsin LWCB is an agency of the State of Wisconsin. The <br /> LWCB is attached, for administrative purposes, to the State of Wisconsin Department of <br /> Agriculture, Trade and Consumer Protection (department). The department is responsible <br /> for providing administrative support to the LWCB. <br /> (2) The LWCB and the department are jointly responsible for administering <br /> Wisconsin's farmland preservation program under ch. 91, Wis. Stats. The farmland <br /> preservation program is designed to preserve agricultural lands and open spaces, to promote <br /> soil and water conservation, to promote orderly land use planning and development, and to <br /> provide tax relief to owners of farmland covered by the program. <br /> (3) In order to participate in the farmland preservation program, a county must adopt <br /> an agricultural preservation plan which is certified by the LWCB. In order to be certified by <br /> the LWCB, a county agricultural preservation plan must comply with standards specified <br /> under subch. IV of ch. 91, Wis. Stats. Among other things, a county agricultural <br /> preservation plan must designate agricultural preservation areas which are to be preserved for <br /> agricultural use. The LWCB may certify county agricultural preservation plans and plan <br /> amendments. <br /> (4) Pursuant to ch. 91, Wis. Stats., and LWCB bylaws, the department reviews all <br /> requests for LWCB certification of agricultural preservation plans and exclusive agricultural <br /> zoning ordinances. The department may ask a requester to provide relevant information and <br /> documentation related to a certification request. Based on its review, the department <br /> prepares a recommendation and proposed decision for consideration by the LWCB. <br /> (5) The State of Wisconsin Land Conservation Board (the predecessor of the LWCB) <br /> certified the Dane County agricultural preservation plan in 1981. <br /> (6) On November 27, 1996, Dane County submitted to the department, for certification <br /> by the LWCB, a proposed amendment to the county agricultural preservation plan. The plan <br /> amendment changes the plan text and map for the Town of Oregon in Dane County. <br />
