**C. The application now contain a revised reclamation plan description as follows: <br /> The final reclamation of the site will be in accordance with the final contours as shown on the <br /> site plan. The topsoil stored in the berms will be respread over the disturbed area, and the area <br /> will be seeded,mulched and fertilized to restore cover over the disturbed area. <br /> The area disturbed in 1997 will be restored with topsoil prior to the end of the 1997 construction <br /> season. All areas disturbed before September 1, 1997 will be finish graded,topsoiled, seeded, <br /> fertilized, and mulched prior to September 15, 1997. These areas will be seeded with a <br /> permanent seed mixture No. 10 as per the DOT Specifications. Areas disturbed after September <br /> 1, 1997 will be topsoiled before the end of the 1997 construction season, and will be temporarily <br /> seeded for winter. These sites will be seeded with a DOT Borrow Pit Mixture, which consists of <br /> 60%rye and 40%permanent seed. <br /> The area disturbed in 1998 will be completely restored prior to September 1, 1998. The topsoil <br /> which is stripped will be respread over the site, and the area will be seeded, fertilized, and <br /> mulched. This area will be seeded with a No. 10 seed as per the DOT Specifications. <br /> Upon completion of the reclamation of the site,the area will have no slopes steeper than 3:1, and <br /> there will be a 15' setback from any property lines. The final contours will blend into the natural <br /> surroundings to create a natural looking landscape. This project will leave the property owner <br /> with additional agricultural land along the flat portion of the site. <br /> This plan now also has one sheet of cross section drawing of the finished site. <br /> The site drawings do not propose any berming other than adjacent to the wet land. The site will be <br /> visible to westbound traffic on 12 & 18. There are other borrow areas further to the east which are <br /> already exposed. The highway, wetland and undisturbed agricultural area on this property bound the <br /> site on three sides. The Swenson property is located on the NW side on high ground with heavy <br /> vegetation. The draft conditions contain the same language as the previous CUP 1405 for full fencing <br /> (item 4). <br /> D. The application indicated no hours of operation but conversations with the applicant suggested <br /> that 6:00 AM to 6:00 PM would be sufficient, or other hours could be negotiated. Week end hours <br /> were not reviewed. The subject was not reviewed by the Town. Hours have been included in the <br /> draft conditions under item 6. <br /> E.. Zoning staff have indicated that the location will not need a special exception permit from the <br /> Board of Adjustment. <br /> F. The Town has approved this CUP with conditions. These conditions have been added to a <br /> suggested list of conditions attached(items 8 & 12- 22). These balance of the conditions are similar <br /> to the condition used for CUP 1405. The ZNR Committee may wish to clarify the time line for the <br /> project as specified in the Town Conditions in their item 8. and are renumbered in the draft conditions <br /> as item 19. The suggested list of conditions also has been modified to add the recommendations to <br /> reflect the Town conditions on Bonding. This is a potential duplication of County Bonding <br /> requirements in item 3. The County requirements is for reclamation work. The Town Bonding is not <br /> clear. <br /> **The Town has also indicated that they will be holding a hearing on this item in June. The Town <br /> hearing is based on an annual review of quarry operations in the Town and compliance with the Town <br /> Ordinance for Mining Operations. The applicant in this case needs a permit from the Town under <br /> provision of the Town regulation in order to operate. Some residents of the Town were interested in <br /> this project and the importance of the June hearing was emphasized to those residents. <br /> III CONCLUSIONS <br />
