A. The Applicants have asked for action at the Public Hearing. If the committee is inclined to take <br /> such action, staff suggests approval subject to the attached conditions. These include the 11 <br /> conditions detailed by the Town of Cottage Grove. <br /> CONDITIONAL USE PERMIT# 1414 by Carl Rattman to allow mineral extraction site on <br /> property located North and South of 3098 Hope Hollow Trail in part of the Section 30&31, <br /> Town of Cottage Grove. <br /> 1. **The applicant shall operate the quarry in compliance with an erosion control plan covering the <br /> entire CUP area for the duration of operations,this plan shall be approved by the Dane County <br /> Land Conservation Office prior to commencing extraction operations. <br /> 2. The applicant shall apply for and receive all other required local,state and federal permits, <br /> including but not limited to a zoning permit from the Zoning Division. <br /> 3. Reclamation shall be completed within one year after operations have ceased, and shall <br /> follow the applicant's submitted"Restoration Plan" as stated in the application and as shown on <br /> the drawings submitted with the application. The operator shall post and maintain at all times <br /> during the term of the CUP a bond in favor of the County in the amount of$15,000 payable to <br /> Dane County to ensure compliance with the reclamation plan. <br /> /4. The excavation area shall be enclosed with a woven wire fence aligned as shown on the <br /> submitted"Site Initiation Plan." The fence shall have one strand of barbed wire on the top,with <br /> a total height of not less than five feet. The haul road and any other access points shall have gates <br /> securely locked when the extraction site is not in operation. The site shall be signed"no <br /> trespassing." <br /> 5. The operator shall maintain the haul road in a dust free manner in accordance with local, <br /> state, and federal regulations. <br /> 6. Hours of operation, shall be from 6:00 a.m.to 6:00 p.m.,Monday through Friday,and from <br /> 8:00 a.m.to 1:00 p.m. on Saturdays. No operations of any kind shall take place on Sundays or <br /> legal holidays. Hours of operation may be temporarily extended for special circumstances,but <br /> only after approval by the Town Board. <br /> 7. There shall be no crushing,screening,blasting or drilling on the site. <br /> 8. **A water truck will be on site at all times for dust control on the haul roads and adjacent <br /> roadways. A power broom will be located on the projects,and will be used to clean Highway <br /> 12/18 of any mud and debris that is tracked onto the road. The operator shall spray the site with <br /> water if and when needed to control dust. The need to spray may be determined by the Zoning <br /> Administrator if he/she determines it is necessary. <br /> 9. There shall be no bulk fuel stored on site. All excavation equipment, shall be fueled in <br /> areas of higher elevation with soil ground cover. All other equipment shall be serviced and <br /> fueled off site. <br /> 10. No water shall be pumped or otherwise removed from the site in order to maintain <br /> groundwater discharge to adjacent wetlands. <br /> 11. The operator shall require all trucks to have muffler systems which meet or exceed then <br /> current industry standards for noise abatement,and shall require all excavation equipment to meet <br /> or exceed the then more current industry standards for noise abatement. <br /> 12. Applicant shall maintain compliance with the Town of Cottage Grove Ordinances Chapter. <br /> 13. Applicant shall submit a map and legal description confirming that the borrow area covers <br /> approximately 15 acres as identified on the topographical map submitted with the applicant to the <br /> Town of Cottage Grove. <br /> 14. Applicant shall supply written confirmation that no effigy mounds or similar sites exist at <br /> the location of the excavation area. <br />
