Page Three: <br /> 10. The owner/applicant shall notify, in writing, the Town of <br /> Christiana Clerk, Wisconsin Power and Light, and the <br /> residents living within one quarter (1/4) mile of the pit <br /> the dates of blasting at the quarry. Said written <br /> notification shall be provided more than 72 hours prior to <br /> the blasting. <br /> 11. Special impact considerations to be applied to the <br /> locations numbered one (1) (yellow-middle page- # 1, <br /> Exhibit A) and two (2) (yellow-middle right #2 , Exhibit A) . <br /> Both of these parcels and residential locations will be <br /> offered the following by applicant: <br /> A. Due to the potential impact on the property values, if <br /> the parcel owners so desire, at the time of transfer, <br /> the owner/applicant shall buy at the price established <br /> in subparagraph B. or pay the difference between the <br /> actual sale price and the price derived from the 1995 <br /> equalized value, corrected to the year of sale, to the <br /> parcel owners. <br /> B. The fair market value shall be established using the <br /> 1995 assessment and the apply the equalization factor <br /> to establish the current fair market value. <br /> This consideration was offered by the applicant. <br /> 12 . There shall be a minimum of a 500 foot set back which shall <br /> include a living fence from the Anderson residential property <br /> lines. (see residential locations on the map) <br /> There shall be a minimum of a 80 foot set back from all <br /> Township roads. <br /> There shall be a minimum of a 200 foot set back from all <br /> other property lines. <br /> 13 . The applicant shall create and install berming along the <br /> town road which shall be a minimum of three (3) feet high and <br /> commence eighty (80) feet from the Township Road right of way. <br /> The Berm shall be seeded and evergreens planted and irregularly <br /> spaced to provide a solid vegetation and living fence. The <br /> evergreens shall be spaced not greater than 10 feet apart and <br /> shall be, at planting, a minimum of 3 feet in height. The cover <br /> seeding shall consist of a grass and alfalfa or ground cover <br /> mixture. <br /> 14 . The hours of operation shall be limited to 6 : 00 a.m. to <br /> 7 : 00 p.m. Monday through Friday and 7: 00 a.m. through Noon on <br /> Saturday. There shall be no Sunday operations. Crushing of <br /> stone shall be limited to 6: 00 a.m. to 6: 00 p.m. , Monday through <br /> Friday. Crushing shall not be permitted on Saturday, Sunday, or <br /> legal holidays. <br />
