Page Three: <br /> 8 . Owner shall comply with all Township, County, State and <br /> Federal requirements regarding blasting. All blasting shall <br /> be performed in strict accordance with State of Wisconsin <br /> rules and regulations. No explosives shall be stored on the <br /> quarry site. No blasting will have peak particle velocity <br /> which exceeds 0 . 3 inches per second when measured in <br /> accordance with State of Wisconsin Blasting regulations. <br /> 9 . The hours of operation shall be limited to 6 : 00 a.m. to 9 : 00 <br /> p.m. Monday through Friday and 7 : 00 a.m. through Noon on <br /> Saturday. There shall be no Sunday operations . Crushing of <br /> stone shall be limited to 6 : 00 a.m. to 9 : 00 p.m. , Monday <br /> through Friday. Crushing shall not be permitted on Saturday, <br /> Sunday, or legal holidays. <br /> 10. The Owner/Operator shall notify, in writing, the Town of <br /> Christiana Clerk, Wisconsin Power and Light, and the residents <br /> living within one quarter (1/4) mile of the open excavation <br /> area of the quarrying activity the dates of blasting at the <br /> quarry. Said written notification shall be provided more than <br /> 72 hours prior to the blasting. <br /> 11. There shall be a minimum of a 500 foot set back which shall <br /> • include a living fence from the Anderson residential property <br /> lines. (see residential locations on the map) <br /> 12 . Special impact considerations to be applied to the locations <br /> numbered one (1) (yellow-middle page- # 1, Exhibit A) and two <br /> (2) (yellow-middle right #2 , Exhibit A) . Both of these <br /> parcels and residential locations will be offered the <br /> following by applicant: <br /> A. Due to the potential impact on the property values, if <br /> the parcel owners so desire, at the time of transfer, the <br /> owner/applicant shall buy at the price established in <br /> subparagraph B. or pay the difference between the actual <br /> sale price and the price derived from the 1995 equalized <br /> value, corrected to the year of sale, to the parcel <br /> owners. <br /> B. The fair market value shall be established using the 1995 <br /> assessment and the apply the equalization factor to <br /> establish the current fair market value. <br /> 13 . There shall be a minimum of a 80 foot set back from all <br /> Township roadway right of way lines. <br /> 14 . There shall be a minimum of a 200 foot set back from all <br /> 40 property lines of other owners. There is no set back <br />
