Mr. Lee asserts that <br /> approval to mine gravel from entire parcel #815 was granted <br /> prior to the existance of the Land Use Plan.There is <br /> presently a pit some 12 to 15 feet deep with piles of dirt <br /> on the property. Mr. Lee plans to fully restore the present <br /> pit and all areas opened by future extraction. No town roads <br /> will be impacted as there is an existing private drive which <br /> exits directly onto 12 & 18 .There are no plans to bring on <br /> skit any material for storage or landfill on the site. He <br /> intends full compliance with the mineral extraction <br /> ordinance. <br /> Appearances: Eugene Skaar discusses land preservation but is not <br /> opposed to this proposal. No one appears in opposition. <br /> Questions raised by the commission. Dust problems resulting from <br /> black top drying. Ans. Regarding traffic problems, <br /> Mr. Lee agrees to try to establish a deceleration lane for safety <br /> purposes. <br /> MotionRecommend approval of CUP with restrictd hours of hauling <br /> (8:00AM to 4:00PM) , recycle blacktop on private drive , overall <br /> time period for use of 10 years, under no circumstances would <br /> there be hauling and disposal of material onto the site, along <br /> with compliance with the Town Mineral Extraction Ordinance. by <br /> Mr. Scherer. Seconded by Mr. Hampton. Motion carried. <br /> Mary Kelly - 4728 Gaston Circle -2 lots -s Restore to zoning of <br /> 1985. <br /> Wants to build a garage and equipment building on the larger <br /> parcel . However, present zoning would not permit the size <br /> and location desired. Ms. Kelly claims that the Township <br /> unilaterally changed the zoning in 1985 over her objections. <br /> She now wants the Town to restore the original zoning, admit <br /> that the Town took an improper action, and the Town should <br /> pay the cost of changing the zoning. According to the Zone <br /> book chapter 12 section 12.06f it would be necessary to zone <br /> the property as A2 in order to build the garage . <br /> The record clearly shows that in December of 1985 , the <br /> Township undertoo a project to correct the non compliance <br /> of certain properties in the Township.
