Sight line evaluation by Mr. <br /> Niesen shows that much of the adjoining subdivision is already <br /> screened from the view of this parcel by the natural topography of <br /> the land, and those not so screened would not be able to be <br /> screened by a berm or other reasonable screening. Beming the <br /> northeast side of the parcel would also adversely affect the <br /> drainage of the adjoining parcel to the east. <br /> D. Arguments Supporting Approval Of This Petition. <br /> (1) The Proposed Rezoning Is Entirely Consistent With Town <br /> Land Use Policies. <br /> Although it was inappropriate to place the A-1 Exclusive <br /> Agricultural zoning blanket over this parcel and it is <br /> inappropriate to apply farmland preservation policies to this <br /> parcel because of the absence of farm value, rezoning this parcel <br /> to allow the proposed rural development complies and is consistent <br /> with the Town Land Use Plan. The proposed rezoning would allow <br /> small family owned and operated landscape contracting and garden <br /> center businesses that would provide services locally. The Town <br /> Land Use Plan specifically allows rezoning for small family owned <br /> and operated businesses that provide a service to the community in <br /> designated agricultural preservation areas. The Town Land Use Plan <br /> allows the Town to approve the proposed rezoning of this parcel for <br /> small family owned and operated landscape contracting and garden <br /> center businesses that provide a service to the community. <br /> (2) Prior To The Effective Date of A-1 Exclusive Agriculture <br /> Zoning. This Parcel was Not Eligible or Suitable For A-1 Exclusive <br /> Agriculture Zoning Under The Applicable Statutes And Ordinances; It <br /> Should Have Been Rezoned To Allow Rural Development Rather Than <br /> Covered By Blanket A-1 Exclusive Agriculture Zoning. <br /> Prior to the effective date of A-1 Exclusive Agricultural <br /> zoning coverage, this parcel was not eligible or suitable for A-1 <br /> Exclusive Agricultural zoning under the applicable statutes and <br /> ordinances and, accordingly, should have been excluded from A-1 <br /> Exclusive Agricultural zoning blanket coverage. This parcel should <br /> have been rezoned to allow rural development instead of A-1 <br /> Exclusive Agriculture zoning applied in blanket fashion for the <br /> following reasons. <br /> Chapter 91 of the Wisconsin Statutes is the Farmland <br /> Preservation Law. Under Section 91. 01 of the Wisconsin Statutes, <br /> "eligible farmland" is defined as a parcel of 35 or more acres of <br /> contiguous land which is devoted primarily to agricultural use. <br /> Section 91.75 of the Wisconsin Statutes provides that the minimum <br />
