ORDINANCE AMENDMENT #5291 � ,/� <br /> /C Cj <br /> AMENDING CONDITIONAL ZONING DEED RESTRICTION <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> conditions or restrictions imposed by Ordinance Amendment #3360 on property <br /> located in the Town of Windsor be amended. <br /> DESCRIPTION OF PROPERTY <br /> Part of the SW 1/4 SW 1/4 of Section 29, Town of Windsor described as follows: <br /> Lot 2, Certified Survey Map #4581 Volume 20 Page 88, recorded in the office of <br /> the Register of Deeds. <br /> AMENDED DEED RESTRICTIONS AND CONDITIONS <br /> The following restrictions and conditions shall replace those previously <br /> imposed by Dane County Ordinance Amendment #3360. <br /> RESTRICTIONS <br /> 1. Use of the property is limited to: <br /> a. Retail business uses. Said uses, except those listed in c. and d. <br /> below, shall be contained within an enclosed building. <br /> b. Repair, maintenance or sale of automobiles or pick-up trucks not <br /> exceeding 12,000 lbs gross vehicle weight. <br /> c. Outside storage of not more than 8 vehicles for repair. Said <br /> vehicles shall be stored only in area "A" as shown on Site Plan <br /> submitted. Area "A" shall be screened by an opaque fence on the <br /> East, West and South and on the North side where the area extends <br /> East of the building. Said fence shall not be less than 6 feet or <br /> more than 8 feet in height. <br /> d. Outside display of not more than 5 vehicles for sale purposes only. <br /> Said vehicles shall be displayed only in area "B" as shown on Site <br /> Plan submitted. <br /> e. Parking space for the vehicles of customers and for the owner's and <br /> employee's vehicles which are used for their personal transportation. <br /> f. Signs are limited to "on-premise" type only. <br /> CONDITIONS <br /> a. Landscaping shall be implemented and maintained as specified on the Site <br /> Plan submitted. <br /> b. The landscaping and other proposed improvements e.g. fencing, lighting, <br /> flag poles and paving, shall be completed by Nov. 1, 1992. <br /> c. The Windsor Town Board in November 1992 shall review owner performance <br /> in completing the improvements and may require the owner to provide an <br /> irrevocable letter of credit in the amount of 115% of the estimated cost <br /> of completing any remaining or unfinished improvements. The letter of <br /> credit, if required by the Town Board, shall be filed with the Town by <br /> Dec. 1, 1992. <br />
