• <br /> EXHIBIT B <br /> CONDITIONAL USE PERMIT #643 <br /> CONDITIONS <br /> NOTE: Conditions have been revised to reflect the Board of Adjustment <br /> decision made on June 23, 1988. <br /> Time periods for deadlines and expiration of the permit have been revised to <br /> commence with the date of filing of the decision by Circuit Court Judge <br /> Pekowsky to affirm the decision of the Dane County Agriculture, Environment & <br /> Land Records Committee in the issuance of this permit. Case #88CV542 - <br /> Decision filed August 16, 1989. <br /> HOURS OF OPERATION: <br /> 1. Operations, excluding blasting, may begin at 6:00 a.m. Monday - Saturday. <br /> 2. Blasting may begin at 7:00 a.m. Monday - Saturday. <br /> 3. Drilling, blasting and crushing shall cease at 7:00 p.m. Monday - Friday <br /> and at 12:00 noon on Saturday. <br /> AREA: The North line of the conditional use permit area shall be in-line with <br /> the South right-of-way line of Sandy Lee Lane. <br /> BLASTING: Blasting will be done in accordance with the applicable <br /> restrictions contained in the Wisconsin Administrative Code regulations. When <br /> blasting, seismographic readings will be maintained below 0.40 in./sec. The <br /> seismograph will be located at various positions around the perimeter of the <br /> quarry property. This level is 20% below the ceiling allowed by the Wisconsin <br /> Administrative Code for blasting activities. When blasting is to be done, the <br /> neighbors will be notified in writing no less than eighteen hours in advance <br /> of the proposed blasting operation. Madison Crushing will notify those <br /> neighbors who which to be notified on Felland Road, from 5152 Felland Road to <br /> Burke Road, on Burke Road from Felland Road to Reiner Road, on Reiner Road <br /> from Burke Road to 5107 Reiner Road and all homes on Sandy Lee Lane. <br /> Seismograph records will be filed with the Town within seven (7) working days. <br /> BERMS: Berm along Reiner Road is to be no less than seven feet high from the <br /> Reiner Road center line elevation with 3 to 1 slope on Reiner Road side. The <br /> berm to be constructed 40 feet from the center line of Reiner Road. This berm <br /> is to be completed in the Spring of 1990 on the permitted area along Reiner <br /> Road. Madison Crushing will also assist the Town of Burke to clean up the <br /> ditch line the full length of the quarry operation. (The existing trees will <br /> be left for dust control until the new planting have grown) . A seeded berm <br /> will be built westerly along the North line of the subject area not less than <br /> four feet in height, as stripping material becomes available, but not later <br /> than the Fall of 1990. <br /> FENCING: The entire quarry will be enclosed by a woven wire fence located one <br /> foot inside the property line and a locked gate at the North entrance. The <br /> fence along Reiner Road and the North line of the C.U.P. will be installed in <br /> the Spring of 1990, the entire quarry will be fenced by the Fall of 1990. <br />
