Page -2- <br /> September 26, 1993 <br /> Mr. Lyman Anderson, Chairman <br /> Dane County Zoning and Natural Resources Committee <br /> "1. That the establishment, maintenance, or operation of the <br /> conditional use will not be detrimental to or endanger the <br /> public health, safety, comfort, or general welfare." <br /> a. What can be more dangerous than a blasting <br /> operation designed to last 10 years and remove over 2 million <br /> tons of rock. <br /> b. The rock will be dug as deep as 50 feet and the <br /> number of individual blasts will be too numerous to easily <br /> count. Shock waves from the blasts will not be confined to <br /> the Wingra property because of numerous hidden faults and <br /> fissures in the rock. <br /> c. Dust and noise will be constantly generated not <br /> only from blasts but from crushing and trucking operations. <br /> The petitioner has not offered any limits on either the timing <br /> or number of blasts or the hours of operation which could run <br /> from dawn to dusk weekdays and Saturday. <br /> "2. That the uses, values and enjoyment of OTHER property in <br /> the neighborhood for purposes already permitted shall be IN NO <br /> FORESEEABLE MANNER substantially impairer or diminished by <br /> establishment, maintenance or operation of the conditional <br /> use." <br /> a. There are presently more than 20 housing units <br /> adjacent to the Wingra property to the South. Within 9 months <br /> single family housing will start to the West and North. All <br /> of the existing land uses have been approved by Regional <br /> Planning. In fact, several years ago an interceptor sewer was <br /> installed through the edge of our property which was designed <br /> to service all of the lands lying South of CTH PD and East of <br /> Maple Grove Road. Clearly, single family housing with <br /> children is not compatible with mining operations especially <br /> when that mining will come within 20 feet of platted lots. <br /> b. The mining operation will also be an <br /> "attractive nuisance" to children who will hear the blasts and <br /> be attracted to the activity on the site. Certainly, large <br /> fences will be necessary to keep out curious children although <br /> such fences have not been suggested by Wingra Stone and won't <br /> be very visually attractive to the neighborhood. <br /> "3. That the establishment of the conditional use will not <br /> impede the normal and orderly development and improvement of <br /> the surrounding property for uses permitted in the district." <br />
