" Y <br /> 6 . SBP shall have the power and absolute discretion to authorize <br /> a variance from any of the requirements of these Covenants <br /> and Restrictions. V26229P 7 <br /> 7. Lots "A" thru "L" may not be divided Into additional building <br /> Lots, except as noted In Covenants and Restrictions • 8 <br /> below, for a period of thirty (30) years from the effective <br /> date of this agreement unless such action Is initiated by the <br /> Town of Verona or some other municipality. This Covenant and <br /> Restriction shall not be construed to prevent the use of one <br /> Lot and part or all of another Lot as one building site, <br /> providing SBP approves such usa. <br /> 8. Lots "F" & "G" may be divided. A portion of Lot "G" may be <br /> transferred to Lot "F" so as to give Lcc "F" legal access to <br /> Grandview Road and thus make it a buildable lot . <br /> 9. The rear 300 feet of Lots "D" through "L" Is to become a <br /> commons area and must not be fenced, (The total commons area <br /> shall be approximately 600 feet by 1300 feet for a total <br /> combined area of approximately 18 acres that Is to used and <br /> enjoyed by all owners of Lots "D" through "L" . ) , except along <br /> the east boundary of Lots "H" and "L" and west boundary of <br /> Lots "0" and " 1 " . The commons area over a Lot shall be an <br /> easement over such Lot and shall not divest the owner of <br /> title to such Lot . The following restrictions shall apply to <br /> this area: <br /> a . Motorized vehicles (Examples: dirt bikes, all terrain <br /> vehicles, snowmobiles, motorcycles) shall not be allowed <br /> In the commons area . <br /> b. Horses may be ridden throughout the commons area. <br /> c. Walking, riding and cross country skiing trails may be • <br /> established by agreement of the owners. <br /> d . No buildings can be erected . <br /> 10. There shall be no buildings or Improvements on the rear 600 <br /> feet of each Lot . Fences may be constructed on each Lot so <br /> as to separate the commons area of each Lot from the <br /> remainder of each Lot . <br /> 11 . Restrictions * 9 & 10 above may be waived by SBP for Lot "L" <br /> because of Its unique terrain. The most suitable building <br /> site may lie within the rear 600 feet of the Lot . If so, the <br /> owner of Lot "L" has the right to withdraw from the commons <br /> area at the time of construction. If It Is withdrawn, th<i <br /> owner of Lot "L" will lose Its rights to use the commons <br /> area. <br /> 12. The rear 300 feet of Lots "A" through "C" is to become a <br /> commons area and must not be fenced, (The total commons area <br /> shall be approximately 300 feet by 860 feet for s total <br /> combined area of approximately 4.5 acres that Is to used and <br /> enjoyed by all owners of Lots "A" through "C" . ) , except along <br /> the north and the west boundary of Lot "A" and the north and <br /> Page 7 of 10 pages <br />
