is lighted at night, this site will become a magnet for users <br /> from outside the community that don't want lights, alcohol, <br /> traffic, litter, and noise "in their backyard. " The residency <br /> rule would ensure that this town park would be used by residents <br /> of this area. Nighttime activity becomes much more offensive to <br /> the neighbors if alcohol is being sold, 2 and if motorized traffic <br /> can move beyond the parking lots. The burdens of night lighting, <br /> the growing demand for usage from non-area residents, nighttime <br /> alcohol consumption, increased litter, noise and traffic, should <br /> not be burdens falling only on the families living in this area. <br /> Form of restrictions. The neighbors have thought about the <br /> form that these restrictions should take. We feel that these <br /> restrictions should be placed in restrictive covenants (agree- <br /> ments on the use of real estate) . These covenants, or agree- <br /> ments, would limit use of the Town land, and should also convey <br /> scenic easements to the neighbors. These easements would be a <br /> binding form of agreement to guarantee current and future owners <br /> that their scenic overlook of the park area would not be degraded <br /> by the prohibited activities. <br /> In addition, the restrictions should be placed as conditions <br /> in the conditional use permit for the park, so that the public is <br /> 2 The lights are usually defended on the basis that they are <br /> "for the kids. " The consumption of alcohol, however, is only an <br /> indulgence for adults. Given the support for this program in <br /> this community, any lost revenues from eliminating alcohol from <br /> the program could be readily made up by charging a small <br /> participation fee, or a contribution from the town (which has <br /> heavily subsidized this program already) . Some of us have worked <br /> at the concession stand, and have seen patrons purchase two, <br /> three or more drinks of beer. This is unacceptable from the <br /> standpoint of traffic safety, noise, and the message it sends to <br /> the children in the program. <br /> 3 <br />
