BOARD OF ADJUSTME T H.EA? NG <br /> December 19, 1967 <br /> The Dane County Board of Adjustment met in Room 226, City-County Building, <br /> Madison, Wisconsin at 7:3(J P. M. December 19, 1967 to conduct a public <br /> hearing as published in the notice. The following members of the board <br /> were present: 0. K. Anderson, Chairman, Millard Erickson, Vice Chairman, <br /> and hermann Eisner, Secretary. Also present were G. Massarene, Zoning <br /> Supervisor, Lola Popanz, Zoning , ssistant. <br /> The meeting was called to order, notice read and the following cases <br /> called: <br /> 4. Appeal for a waiver for construction improperly completed on Lot 8, <br /> Block 1, Clyde A. Gallagher Garden Subdivision, in the SIT/4 NEB+, Section <br /> 4, Town of Blooming Grove. <br /> THOSE IN FAVOR: James Ackley, of Ackley and Peterson Builders, explained <br /> that the lot was purchased from Gerke. Ring and a partner staked the lot. <br /> Basements Unlimited was hired and poured the basement. When Ackley went <br /> out to look at it he discovered it was in the wrong place. Signatures <br /> were obtained from adjoining neighbors, stating no objection. Denton <br /> Georgeson, Chairman of Blooming Grove Town Board said obviously a mis- <br /> take was ma:'e and there was no objection to the variance. <br /> THOSE OPPOSED: None OTHERS: none <br /> 2. Appeal for a permit for a house on Lot 16, Borchers Beach Subdivision, <br /> Section 33, Town of Westport. Permit was not issued because of sideyard. <br /> THOSE IN FAVOR: Ear' Cooper, attorney for the owner, explained house <br /> on lot was lost in storm. The Town of Westport building inspector had <br /> told Mr. Watzke to go ahead. After investing 7OO. in the basement he <br /> found he needed a county building permit. The 7 foot side yard made it <br /> necessary to appeal. If the appeal were not granted, he asked for an <br /> alternative of setting the house 3 feet over on the basement in order to <br /> comply. Gerald Tierney and Jerome Ripp of the 'eestport Town Board said <br /> it was a construction error. The town had had a hearing and aftd approved <br /> moving the 25 year old home into the township, even though the Town of <br /> Westport requires that a house moved in be no more than 5 years old. <br /> They stated that the house would be a credit to the area. <br /> THOSE OPPOSED: Wade Boardman appearing for Frances Hurst. He said she <br /> phoned him from Cambridge, England, this morning and requested him to <br /> " 'present her. He waid she hoped to build a nice home on her own lot. <br /> Further, he stated that diluting side yard requirements would only mean <br /> depreciation of the surrounding property. Mrs. Brown, in opposition, <br /> presented a letter from Mr. Woldenberg stating "we are no:longer build- <br /> ing cottages on the lake - only homes - and we must abide by the codes <br /> and assure landowners their rights". Mrs. Brown mentioned that fire <br /> protection would be affected by close structures. Mr. Eisner asked if <br /> the basement was above ground. There was a question as to whether <br /> Woldenberg owned any lots fronting on the lake. <br /> OTHERS: None <br />
