Motion by Dahlk, second by Voges to grant a variance of 7 feet <br /> ALK6 inches from set-back requirements as per finding of fact: <br /> 1. Hoise was built before town's adoption of the ordinance and at less <br /> setback than required by the ordinance. <br /> Porch is needed to protect entrance from wind and rain. <br /> i CONCLUSION: <br /> . a. Variance is necessary to provide right enjoyed by others. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. . <br /> c. Hardship. is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #534. Motion by Voges, second by Dahlk to grant a special exception permit <br /> to build an addition to an accessory building in a flood plain as per <br /> finding of fact: <br /> 1. Accessory huiEing was in existence at the time of the adoption of <br /> the flood plain requirements. <br /> 2. Addition will be near the edge of the flood plain limits and will <br /> not adversely affect the flood storage capacity of the flood plain. <br /> CONCLUSION: <br /> • <br /> a. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> Motion carried. <br /> #535. Motion by Dahlk, second by Voges to grant a special exception <br /> permit to place fill in a flood plain as per finding of fact: <br /> 1. Fill is necessary to divert surface water drainage away from <br /> residence and garage. <br /> 2. Fill will be at a maximum depth of 2 feet and will not adversely <br /> affect the flood storage capacity of the flood plain. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship <br /> b. Variance preserves the zoning ordinance as much as possible <br /> wi out injustice to applicant. <br /> Motion carried. <br /> #536. Motion by Voges ,second by Dahlk to grant a special exception <br /> permit to place fill within 300 feet to the landward side of a flood <br /> plain as per finding of fact: <br /> 1. Fill will serve to divert surface water from a corn field away <br /> from a garden area. <br /> 2. Fill will be placed to minimize erosion with a flood plain area. <br /> CONCLUSION: <br /> a. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #537. Motion by Dahlk, second by Voges to hold in abeyance until the <br /> Board has an opportunity to make an inspection of the property. Motion <br /> 4; carried. <br />
