Minutes Board of Adjustment 9/19/75 <br /> 411* <br /> OTHERS IN FAVOR: None OPPOSED: None TOWN BOARD: Telephone call <br /> from Vernon Mandt, chairman no objection. <br /> #394. Appeal by Geraldine Contreraz for a variance from road setback <br /> as provided by Section 10.17 (1) of the Dane County Zoning Ordinance. <br /> Variance is necessary to permit repair of an barn located in part of <br /> the NW 4 NW4 Section 3, Town of Christiana. <br /> IN FAVOR: G. Contreraz; fire destroyed barn, requesting permission to <br /> replace roof on at least part of the remaining foundation. Question, <br /> Erickson; have you thought of moving the structure further back? <br /> Yes, even part of the foundation would be okay and would actually <br /> improve the in-drive and visability. <br /> OTHERS IN FAVOR: None OPPOSED: None <br /> TOWN BOARD: Walter Lien, chairman. Board is concerned about closeness <br /> to highway and poor visibility, would lave no objection if budding <br /> could be moved back. <br /> The Public Hearing was closed. <br /> #302. Motion by Voges, second by Dahlk to grant Special Exception <br /> Permit for repair and replacement as per finding of fact: <br /> 1. Cottage is existing <br /> 2. No increase in structure <br /> 3. 150' distance from lake <br /> Conclusion: <br /> A. Raised deck, no encroachment on flood plain storage. <br /> 40 B. Not located in flood-way <br /> Motion carried. <br /> #383. Motion by Dahlk second by Voges to grant variance of 14' from <br /> rear yard requirement as per F.O.F. <br /> 1. Existing residence is non-conforming caused by division of pro- <br /> perty <br /> 2. Rear room needs to be replaced <br /> 3. Open farm land adjacent to rear line <br /> Conclusion: <br /> A. Unnecessary hardship <br /> B. Variance required to provide right enjoyed by others. <br /> C. Not contrary to public interest or rights of others. <br /> Motion carried. <br /> #384. Motion by Voges second by Dahlk to grant variance of 24' from <br /> required road setback as per F.O.F. <br /> 1. Existing residence is non-conforming <br /> 2. Structure is damaged on rear portion only and is worth repairing <br /> 3. No increase in non-conformity. <br /> Conclusion: <br /> A. Unnecessary hardship <br /> B.
