MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT <br /> MEETING OF AUGUST 15, 1975 Page 3 <br /> OTHERS IN FAVOR: none. OPPOSED: Gene Zeman, property owner along creek; is <br /> tie opposed if the main purpose of cleaning is to provide overflow capacity to <br /> Sun Prairie se werage problem. Recall: G. Skaar; petition to clean was mad: <br /> by farmers in area and not by Sun Prairie. No one really knows what Sun <br /> Prairie is planning to do. TOWN BOARD: not present. <br /> The Public Hearing was closed. <br /> #372. Motion by Dahlk, second by Voges to grant 421-variance from set-back <br /> and 5' variance from rear yard as per finding of fact: <br /> 1. existing house is nonconforming <br /> 2. addition will not encroach into setback <br /> Conclusion: <br /> • <br /> A. unnecessary hardship <br /> B. variance not contrary to public interest or rights of others. <br /> Motion carried. <br /> #373. Motion by Voges, second by Dahlk to grant a Special Exception Permit <br /> as applied for and a 4' variance from setback from shoreline as per findin:, <br /> of fact: <br /> 1. existing residence is non-conforming <br /> 2. minimal fill will be required <br /> 3. area is served by public sewer <br /> Conclusion: <br /> A. unnecessary hardship <br /> B. variance is not contrary to rights of others or to the public <br /> interest. <br /> C. variance is necessary to provide rights enjoyed by others. <br /> Motion carried. <br /> #374. Motion by Dahlk, second by Voges to grant variance of 1' from side- <br /> yard requirement as per finding of fact: <br /> 1. the variance is required for only 1-2 feet of the proposed garage <br /> 2. neighbors did not object <br /> Conclusion: <br /> A. variance is not contrary to rights of others <br /> B. variance is necessary to provide rights enjoyed by others <br /> Motion carried. <br /> 375.
