Dane County Board of Adjustment -2- May 9, 1974 <br /> B. Board discussed the evidence and legal problems relating to <br /> Appeal #271 (Sidney Bursten) with Mr. Hesslink. The Board finds <br /> that there is no factual dispute involved in this case. Appellant <br /> has applied for Zoning Permits to construct approximately twenty <br /> duplexes on an eighty acre parcel of land which is zoned A-1 <br /> Agricultural. The Zoning Administrator denied the application for <br /> the Permits and cites two reasons for his action: (1) The buildings <br /> would violate the definition of "lot" as contained in the Ordinance <br /> and (2) that the proposed construction would be in violation of the <br /> Land Division and Subdivision Ordinance. <br /> The Board concludes as a matter of law: <br /> 1. That the Zoning Ordinance does not prohibit the construction <br /> of more than one or two single family dwelling units or duplexes <br /> on one parcel of land in an A-1 Agricultural District; <br /> 2. That the Board lacks authority under Chapter 7 and Chapter 10 <br /> of the Dane County Ordinances to interpret questions of law <br /> relating to the Land Division and Subdivision Regulations; and <br /> 3. That the Zoning Administrator lacks authority under the <br /> Zoning Ordinance to require plat approval prior to the issuance <br /> of a Zoning Permit. <br /> Mr. Dahlk moved that the appeal of Mr. Bursten in ;f271 be sustained <br /> and that the Zoning Permits be issued. Mr. Erickson seconded the <br /> motion. The motion carried. <br /> Mr. Dahlk moved and Mr. Erickson seconded that the Board adjourn <br /> subject to the call of the Chairman. Motion carried and the meeting <br /> adjourned at 2:10 P. M. <br /> Harland Dahlk, Secretary <br />
