• <br /> F I 7.1144V4,r na.I 7 <br /> (g) Upon completion of any house upon any Lot, subject, <br /> however, to delays resulting from weather and climatic <br /> conditions, each Owner shall comply with the following • <br /> • landscape requirements: V 2 7 5 6 2 P 3 <br /> • <br /> (i) A minimum of Five Hundred Dollars ($500) <br /> shall be spent on plantings in the front yard by the <br /> buyer of a new home, within nine (9) months of closing. • <br /> (ii) The yard shall be sodded or seeded. This <br /> includes street terraces (including street terraces on <br /> corner lots) . <br /> (iii) Driveways shall be of concrete or blacktop <br /> and shall be installed within one (1) year from the <br /> closing of the purchase of a new home, weather • <br /> permitting. <br /> (iv) Each Owner shall plant in the terrace area <br /> trees in accordance with the street tree planting <br /> :4 schedule approved by the Town of Windsor and attached <br /> hereto as Exhibit A. No person shall plant or maintain <br /> in the terrace area any tree of the species populus <br /> Delioides, commonly called the "Cottonwood," Black <br /> Locust, the seed-bearing "Box Elder" or A,er NegundQ, <br /> which may now or hereafter become infested with Box Elder <br /> bugs, White Poplar, Lombardy Poplar, any evergreen or fir <br /> tree, any fruit or nut tree, or any other species, which <br /> in the opinion of the Town Board, will constitute a <br /> nuisance to the public or adjoining property owners or <br /> interfere with the safety of the public. "Terrace <br /> areas" means the land between the normal location of the <br /> street curbing and sidewalk. There there is no sidewalk, <br /> the area six (6) feet from the curb line shall be deemed <br /> to be a terrace for the purpose of this Declaration. • <br /> Each Owner is hereby notified that the Town of Windsor <br /> may deny a final occupancy certificate until' the required <br /> trees are planted or, if planting must be deferred until <br /> weather permits, a $100.00 deposit is made with the Town <br /> to secure compliance with this requirement. <br /> (h) Each single-family house shall have not fewer than <br /> two (2) nor more than three (3) automobile garage stalls, <br /> which shall be attached to or contained within the single- <br /> family structure. Each duplex or multi-family structure shall <br /> have not less than two (2) nor more than three (3) automobile <br /> garage stalls per dwelling unit, which stalls shall be <br /> attached to or contained within the building housing the <br /> dwelling unit. <br />
