HOARD OF ADJUSTMENT - Minutes <br /> March 22, 1979 <br /> Page 2 <br /> 2. Zoning Ordinance provision of 10 foot side yard provides 20 <br /> feet between buildings. If this variance were to be granted <br /> and another building was constructed on the adjacent property <br /> to the East, the result would be only a 13 foot distance be- <br /> tween buildings and would offset any advantage to a greater <br /> distance between the buildings on the West side. <br /> 3. Vast improvement to property or non-use of property which is not <br /> as a result of the Zoning Ordinance cannot be construed to be <br /> a hardship. <br /> CONCLUSION: <br /> a. Unnecessary hardship not proven. Motion carried. <br /> Appeals held in abeyance. <br /> #754. Hanson & Wiedenfeld, filling shoreland area. Section 22, 23 <br /> Town of Westport. <br /> • <br /> Letter from Department of Natural Resources Engineering, expressing <br /> no objection, was read. <br /> Motion by Voges second by Purcell to grant the Special Exception permit <br /> with conditions: <br /> 1. Bulkhead (dock line) shall be established as per Department of <br /> Natural Resources permit. <br /> 2. Fill shall be deposited in area specified by the plan submitted. <br /> Fill shall be leveled to the existing contours outside of the <br /> 852.6 contour line. <br /> 4ril; 3. Only clean fill material shall be used as per Department of Natural <br /> Resources specifications included in the bulkhead (dock line) <br /> permit. <br /> 4. Fill shall be seeded with fast growing grasses to prevent silta- <br /> tion or erosion. <br /> 5. Inspection by the Dane County Zoning Department shall be requested <br /> upon completion of the project. <br /> Motion was carried. Schwahn voting no. <br /> #755. Kolberg; Special Exception for building site preparation and <br /> relocation of berm Lot #197, East Hill Addition Belmar - Section 5, <br /> Fitchburg. <br /> S.C.S. review of project was discussed. Chairman Dahlk requested Mr. <br /> Kolberg to present his revised, finalized, plans. Mr. Kolberg stated <br /> that, with the exception of minor revision of decks and building loca- <br /> tions to meet yard requirements, the plan was final. Construction of <br /> buildings, landscaping, etc. could be staggered to provide a minimum <br /> of erosion and optimum control. R. Johnson, area resident, urged the <br /> Board to specify explicit control factors if they decided to issue <br /> the permit. <br /> Motion by Schwahn second by Purcell to grant the Special Exception Permi. <br /> with conditions: <br /> 1. A revised soil erosion plan shall be submitted which satisfies <br /> S.C.S. concern as expressed in the review of March 13, 1979 by <br /> Glen Kinderman, item 6, 10, and "overall" statement. <br /> C <br />
