OTHERS IN FAVOR: None OPPOSED: None <br /> 460 TOWN BOARD: Phillip Esser (phone call) - no objection. <br /> #588. Appeal by Richard Fisher for a special exception permit, as pro- <br /> vided by Section 10.33 (c) (2) Dane County Zoning Ordinance, to construe <br /> a residential garage and add a deck to a residence on property located <br /> in a flood plain area in the SE 1/4 NE 1/4 Section 23, Town of Mazomanie. <br /> IN FAVOR: R. Fisher OTHERS IN FAVOR: None OPPOSED: None <br /> TOWN BOARD: Not present. DNR - no communication. <br /> The public hearing was closed. <br /> #577. Motion by Voges second by Dahlk to grant a 5 foot variance <br /> from required right side yard as per finding of fact. <br /> 1. Required location of well, septic and house and area of bed- <br /> rock make it impossible to locate pool in any other location. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the <br /> public interest. <br /> d. Hardship is caused by the ordinance and is not self- <br /> imposed. <br /> C; #578. Motion by Dahlk second by Voges to grant variance of 8 feet <br /> required rear yard as per finding of fact: <br /> 1. Existing residence is non-conforming. No addition could be <br /> built on rear side without a variance. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed others. <br /> c. Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried. <br /> #579. Motion by Voges second by Dahlk to grant a 2 foot variance <br /> from left side yard for addition to residence and a 5 foot variance <br /> from left side yard for addition to garage as per finding of fact: <br /> 1. Pie shape of lot with rear width being less than front width, <br /> create problem. <br /> 2. Lots on either side because their consistant width is less than <br /> 60 feet need only a total of 15 feet fro side yard with mini- <br /> mum of 5 feet on one side. This lot with 53 feet rear and 83 <br /> feet front averages 68 feet width requiring 10 feet each side. <br /> 3. Existing garage is non-conforming in location. <br /> CONCLUSION: <br /> Cr, a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the <br /> public interest. <br /> d. Hardship is caused by the ordinance and is not self-imposed. <br />
