The parcel of land has adequate area on which a residence could <br /> be built without the necessity of filling. <br /> 2. The next two properties to the NE 1/4 have a width of 140 feet <br /> more or less. <br /> 3. Shoreland regulations were inplemented to protect these areas <br /> and no hardhsip was presented to show why they sould not pre- <br /> vail. <br /> 4. There is no frontage on a public road which is a certified sur- <br /> vey requirement before a parcel of land may be divided and no <br /> facts were presented to show that retention of the parcel as <br /> a whole would cause hardship. <br /> CONCLUSION: <br /> a. There is no proven hardship nor violation of rights en- <br /> joyed by others. Motion carried. <br /> #581. Motion by Voges second by Dahlk to deny as per finding of fact: <br /> 1. Don Simon is a realtor, developer and builder who should be <br /> aware of zoning requirements. <br /> CONCLUSION: <br /> a. Hardship was self-imposed. Motion carried. <br /> #582. Motion by Dahlk second by Voges to grant variance of 14 feet <br /> from required setback from Reiner Road and deny height variance for <br /> accessory garage, recreational building as per finding of fact: <br /> 1. Porch was added to be in-line with neighboring houses. 76 feet <br /> from centerline of road. Problem was caused by City'of Madison <br /> requiring 27 feet of additional land for future right-of-way <br /> when survey was submitted. <br /> 2. Height variance due to preference of applicant. <br /> CONCLUSION: <br /> a. Additional land for some future undetermined date causes <br /> hardship. <br /> b. Variance is not contrary to rights of others or to the <br /> public interest. <br /> c. No hardship proven for height appeal. <br /> Motion carried. <br /> #583. Motion by Dahlk second by Voges to grant a variance of 20 feet <br /> from required setback from centerline of STH 19 as per finding of <br /> fact: <br /> 1. Addition is not possible on any other side of barn because of <br /> farm drive and yard area, existing silos and feed bunks and the <br /> residential area to the West. <br />
