Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> c. Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried. <br /> #584. Motion by Voges second by Dahlk to grant a 27 foot variance <br /> from required setback from centerline of USH 14 as per finding of <br /> fact: <br /> 1. Pool was built with understanding that a Dane County permit <br /> was not required. <br /> 2. Location was chosen to preserve trees and to be outside of <br /> drainage and wetland areas. <br /> CONCLUSION: <br /> a. Variance preserves the zoning ordinance as much as possi- <br /> ble without injustice to applicant. <br /> b. Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried. <br /> #585. Motion by Dahlk second by Voges to grant a variance of 23 feet <br /> from required setback from centerline of Viaduct Road as per finding <br /> of fact: <br /> 1. Proposed building is located to preserve as much agricultural <br /> lands as possible while not preventing machinery, etc. access <br /> to existing buildings. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br /> c. Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried. <br /> #586. Motion by Voges second by Dahlk to grant a special exception <br /> permit to construct an irregation pond adjacent to Door Creek as per <br /> D.N.R. and A.S.C.S. specifications. All banks shall be seeded to <br /> prevent erosion. <br /> • <br /> Motion carried. <br /> #587. Motion by Dahlk second by Voges to waive applicant appearance <br /> and grant a variance of 7 feet from required distance from centerline <br /> of Prairie Ridge Road as per finding of fact: <br /> (111: 1. Entry is needed to protect entry and conserve heat in winter. <br />
