Motion by Voges, second by Dahlk to grant the Special Exception <br /> Permit to grade and fill as specified in application: <br /> 1. no major filling; back-fill for basement and filling of a 6 ft. <br /> by 30 ft. rutted, eroded area. <br /> 2. spreading, leveling of black dirt, "top-soil" to a depth of 2 to <br /> 3 inches. <br /> 3. entire area will be seeded to prevent erosion or siltation. <br /> Motion carried. <br /> #554. Motion by Dahlk, second by Voges, to grant withdrawal of appeal. <br /> Motion carried. <br /> : 555. Motion .by Dahlk, second by Voges, to grant a variance of 3 feet from <br /> required setback from Seybold Road as per finding of fact: <br /> 1. Seybold Road is only a 60 foot R.O,W, . Therefore, as per Sec. <br /> 10.17 (3)(b) a 63 foot setback is required from the center-line <br /> of the road. This requires a 33 foot setback from the front prop- <br /> erty linewhereas on a regular 66 foot R.O.W. the 63 foot from <br /> center-line would be only 30 feet from the front property line. <br /> 2. addition to the rear or side would be impossible as these areas <br /> are required for driveway, loading area and parking. <br /> CONCLUSION <br /> A. Proven case of unnecessary hardship. <br /> B. Variance preserves the zoning ordinance as much as possible with- <br /> out injustice to the individual. <br /> C. Hardship is caused by the ordinance and is not self imposed. <br /> Motion carried. <br /> 6556. Motion by Voges, second by Dahlk, to grant a variance to permit the <br /> proposed accessory building to be 880 sq. ft. larger than than the <br /> 864 sq. ft. maximum allowed by the zoning ordinance, and a variance <br /> of 3 feet from height restrictions as per finding of fact: <br /> 1. existing residence does not have an attached garage. <br /> 2. any size garage addition, subject only to lot coverage require- <br /> ment, could be added to the residence. <br /> 3. seperate building is proposed because of height requirement for <br /> motor home which must have a 12 ft. high door. <br /> CONCLUSION. <br /> A. Variance is required to provide a right enjoyed by others. <br /> B. Variance is not contrary to rights of others or to public interest <br /> Motion carried. <br /> #557. Motion by Dahlk, second by Voges, to deny; <br /> 1. proposed garage is located on a vacant lot - no topographical or <br /> C other problems. <br /> 2.
