Mortenson for a variance from required setback <br /> from road as provided by Section 10. 17 (3) (h) to permit addition to resi- <br /> dence at 50.3( Feiland Road in the SW 1/4 SE 1/4 -• Lot #1 , C.S.M. 3085 - <br /> Section 26, Town of Burke. <br /> TN FAVOR: J. L. Mortenson 'OPPO4;FD: None COMMUNICATION: Letter <br /> TOWN BOARD: In favor. <br /> #1147. Appeal by William Endres for a variance from required setback from <br /> road as provided by Section 10.17 (3) (b) to permit new agricultural acces- <br /> sory building at 6572 Woodland Drive in the SW 1/4 SW 1/4 - Section 12, <br /> Town of Springfield. <br /> IN FAVOR: Win. Endres OPPOSED: None COMMUNICATION: Letter; town board <br /> in favor. <br /> #1148. Appeal by Michael Duerst for a variance from required setback from <br /> road as provided by Section 10.17 (3) (b) to permit construction of silo at <br /> 7313 Schaller Road in the NE 1/4 SW 1/4 Section 4, Town of Montrose. <br /> IN FAVOR: M. Duerst OPPOSED: None COMMUNICATION: Letter; town board <br /> in favor. <br /> The public hearing was closed. <br /> #1142. Motion by Schwahn, second by Harvey to grant a variance of 17 feet, <br /> more or less, from the required setback from Woodland Drive with the <br /> condition: The building shall be removed at the owners expense if future <br /> road improvement requires additional right,-of-way. <br /> FINDING OF FACT: <br /> 1) . Building cannot be located farther back because it will restrict <br /> access to silos. If moved to the West it would encroach into <br /> cropland. <br /> 2) . The building will not encroach any closer to the road than existing <br /> buildings on the property and will replace the older shed which <br /> is only 35 feet from the centerline, thus, improving the situation. <br /> CONCLUSION: <br /> 1. Proven case of unnecessary.hardship. <br /> 2. Variance is not contrary to rights of others or to the public interesi . <br /> Motion carried. <br /> #1143. Motion by Kruschke, second by Schwahn to deny. <br /> FINDING OF FACT: <br /> 1) . Two variances were granted to Mr. Graves when he constructed the <br /> building in 1968. These were a 5 foot variance from required <br /> rear yard in order to provide required parking and a 7,416 square <br /> feet variance from required lot. area. <br /> 2) . Building has been utilized for a combination of apartments and <br /> offices, conversion to additional apartments with less office <br /> space is a desire of the owner; it is not a requirement. Building <br /> ) can still be utilized as is. <br />
