Appeal by Robert J. Drucker for a variance from required side and <br /> rear yards as provided by Section 10.16 (6) (a) 2. to permit addition to <br /> existing boathouse at 3134 Shadyside Drive, part of Lots 6 & 7 - Vea Park, <br /> Section 30, Town of Pleasant Springs. <br /> IN FAVOR: Attorney Scott Herrick, representing R. Drucker OPPOSED: <br /> Richard Briggs COMMUNICATION: None <br /> #1123. Appeal by Richard Story for a variance from required setback from <br /> road as provided by Section 10.17 (4) (b) to permit an entry addition to <br /> building at 5291 Felland Road, North 49.5 feet Lot #2, Lots 3 & 4 and South <br /> 34 feet Lot #5, Gilman and Droster Plat, Section 23, Town of Burke. <br /> IN FAVOR: R. Story OPPOSED: None TOWN BOARD: D. Jones, Chairman, in <br /> favor. COMMUNICATION: None <br /> The public hearing was closed. <br /> #1118. Motion by Kruschke, second by Purcell to grant a variance of 30 <br /> feet more or less, from required rear yard. <br /> FINDING OF FACT: <br /> 1. Existing residence is non-conforming as to rear yard. <br /> 2. Proposed addition will be in-line with the existing house and will not <br /> cause a further encroachment into rear yard area. <br /> 3. Addition may not be built without the variance. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Hardship is cuased by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #1119. Motion by Schwahn, second by Harvey to grant a variance of 384 <br /> square feet from maximum permitted size of an accessory building. <br /> FINDING OF FACT: <br /> 1. Size of residence is restricted because there is no basement nor second <br /> story. <br /> 2. Proposed garage is average, 2 car, size. <br /> 3. several comparable size garages exist in the area. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Variance is necessary to provide right enjoyed by others. <br /> 3) . Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #1120. Motion by Harvey, second by Schwahn to grant the Special Exception <br /> Permit with conditions as follows: <br /> 1. Permit granted as per plans submitted. <br /> 2. All spoils shall be spread and leveled. <br /> 3. The filled and/or graded and disturbed areas shall be sodded or <br /> seeded with fast growing grasses and mulched to prevent siltation or <br /> ' erosion. Specifications of seeding, mulching, etc. , as found in <br /> the U.S.D.A. - S.C.S. Technical Guide shall be adhered to. <br /> 4. Said project shall be completed as early in the Springs, 1983, as is <br /> possible. <br />
