BOARD OF ADJUSTMENT - Minutes <br /> November 19, 1981 <br /> Page 3 <br /> 1410 #1035. Motion by Harvey, second by Purcell to grant a variance of 648 <br /> square feet form maximum permitted floor area for an accessory building <br /> with the condition that said structure shall not be utilized for resi- <br /> dential purposes. <br /> FINDING OF FACT: <br /> 1. Boathouse is needed to protect boats from storm damage, (owner <br /> had one boat smashed on rocks this summer) and to prevent vanda- <br /> lism and theft. <br /> 2. Adjoining neighbor has a boathouse on his property also without <br /> a residence. <br /> CONCLUSION: <br /> 1. Proven case of unnecessary hardship. <br /> 2. Variance is necessary to provide right enjoyed by others. <br /> 3. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #1036. Motion by Schwahn, second by Purcell to deny. <br /> FINDING OF FACT: <br /> 1. Board inspection disclosed that waterway is not a ditch but only <br /> a very shallow swale which carries run-off from farm yard complex, <br /> run-off ponds between barn and corn storage bins and then seeps <br /> down swale to culvert under Goeden Road. <br /> 2. There is ample area to relocate and improve waterway to provide <br /> a complying location for the proposed building. Access to corn <br /> (11, bins would not be hampered. <br /> CONCLUSION: <br /> 1. Unnecessary hardship was not proven. <br /> Motion carried. <br /> #1037. Motion by Purcell, second by Schwahn to grant a variance of 1 <br /> foot 8 inches from required right side yard. <br /> FINDING OF FACT: <br /> 1. Slope of lot to side and rear would require either substantial <br /> filling or excavation to construct garage in any other location, <br /> attached or unattached. <br /> CONCLUSION: <br /> 1. Proven case of unnecessary hardship. <br /> 2. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 3. Variance is necessary to provide right enjoyed by others. <br /> Motion carried. <br /> #1038. Motion by Schwahn, second by Harvey to deny requested variance <br /> from right side yard and to grant a variance of 11 feet from required <br /> setback from C.T.H. "AB" with the following condition: <br /> The garage or pertinent portion thereof shall be removed at the owner- <br /> expense if future road improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> (1) . Sideyard: There is ample room to move the proposed addition <br /> to the left thereby providing complying side yards; owner <br /> 4/04) stated "no problem" . <br />
