AB. <br /> CONCLUSION: <br /> • <br /> (1) . Sideyard: Unnecessary hardship was not proven. <br /> (2) . Setback: 1. Proven case of unnecessary hardship. 2. Vari- <br /> ance is necesary to provide right enjoyed by others. <br /> : 3. Variance is not contrary to rights of others or to the <br /> i public interest. <br /> Motion carried. <br /> 4 <br /> #1039. Motion by Schwahn; second by Purcell to grant a variance of 3 <br /> feet from required left side yard. <br /> FINDING OF FACT: <br /> 1. Addition cannot be made to rear of house because of well location <br /> y 2. Addition to right side of house would require major remodeling <br /> and other problems. <br /> 3. Left side yard was reduced by former owner; neighbor inadvertently <br /> placed his well on this property and land transfer was made along <br /> left line to correct the situation. <br /> CONCLUSION: ' <br /> . 1. Proven case of unnecessary hardship. <br /> 2. Variance is not contrary to rights of others or to the public <br /> interest. <br /> ; CV Motion carried. <br /> #1040. Motion by Purcell, second by Schwahn to grant the Special Excep- <br /> tion Permit as proposed. <br /> SPECIAL INSTRUCTIONS: <br /> 1. All spoils shall be spread and leveled. <br /> • <br /> 2. The filled and/or graded and distrubed areas shall be sodded or <br /> seeded with fast growing grasses and mulched to prevent siltation <br /> or erosion. <br /> 3. The applicant shall request inspection by the Dane County Zoning <br /> Department upon completion of the project. <br /> FINDING OF FACT: <br /> 1. Project has a useful purpose; improvement and landscaping of <br /> properties. <br /> 2. Fill is minimal and is protected from lake erosion by small wall. <br /> CONCLUSION: <br /> 1. The project as planned, with specified conditions; will not <br /> result in substantial detriment to navigable waters by erosion <br /> sedimentation, impairment of fish or aquatic life, or safe <br /> and healthful conditions. <br /> Motion carried. <br /> (1-10) • <br />
