Minutes - Board of Adjustment <br /> May 22, 1980 <br /> Page 2 <br /> The public hearing was closed. <br /> #887. Motion by Voges, second by Dahlk to grant a variance of 40 feet <br /> from the required setback from normal high waterline; area under the <br /> porch may not be enclosed on the lake side. <br /> FINDING OF FACT: <br /> 1. Renovation will not cause residence to be closer to the lake. <br /> 2. Area under the porch is not now enclosed and will not be enclosed <br /> or utilized for residential purposes. <br /> 3. A variance would be required for any renovation or alteration of <br /> the residence because of proximity to the lake. <br /> CONCLUSION: <br /> a. proven case of unnecesary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #888. Motion by Kruschke, second by Schwahn ty grant a variance of 13 <br /> feet from required setback from road. <br /> FINDING OF FACT: <br /> 1. Slope of lot and existing trees prevent conforming location for th: <br /> garage. , <br /> 2. Other properties in the area have unattached garages. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> (NW b. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> c. Variance is necessary to provide right enjoyed by others. <br /> Motion carried. <br /> #889. Motion by Voges, second by Purcell to grant a variance of 13 feet <br /> from the required setback from normal high waterline. Deck may not be <br /> roofed or enclosed. <br /> FINDING OF FACT: <br /> 1. Other residence decks in the area etc. are non-conforming as to <br /> setback from water. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> c. Variance is necessary to provide right enjoyed by others. <br /> Motion carried. <br /> #890. Motion by Purcell, second by Voges to grant the Special Exception <br /> Permit with the following conditions: <br /> 1. Project permitted as per plan submitted - George Weir - #1072/-L. <br /> 2. Disturbance of other area/s outside of the specified pond and <br /> fill areas shall be kept to a minimum. <br /> 3. Banks of pond and fill area shall be seede3 with fast growing <br /> grasses,' or sodded, to prevent erosion and siltation. <br /> tag 4. Pond construction is designed to offset the cubic foot volume of <br /> the fill to be placed in the flood zone. Fill is not permitted <br /> if the pond is not constructed. <br /> • <br />
