Rendall/Quackenbush to grant variance of 20 feet from required <br /> right-of-way setback of Klevenville-Riley Road to permit deck addition to <br /> existing tavern. <br /> FINDING OF FACT: <br /> 1. Addition is a continuation of existing structure and will not encroach <br /> further than already exists. <br /> 2. Existing building is presently at zero setback. <br /> 3. Existing garage presently is entirely within road right-of-way and town <br /> approves. <br /> CONCLUSION: <br /> 1. Variance is not contrary to rights of others or to the public interest. <br /> 2. Hardship is caused by the ordinance and is not self-imposed. <br /> Carried 4-0. <br /> #1765. Quackenbush/Rendall to grant variance of 34 feet plus or minus from <br /> minimum required centerline setback of Moen Valley Road to permit deck <br /> addition to existing residence. <br /> FIND OF FACT: <br /> 1. Existing residence is almost entirely within required setback. <br /> 2. Road dead-ends at applicants property. <br /> CONCLUSION: <br /> 1. Variance is not contrary to rights of others or to the public interest. <br /> Carried 4-0. <br /> #1766. Jones/Quackenbush to grant variance of 18 feet plus or minus from <br /> required setback from right-of-way of Lochinvars Trail to permit construction <br /> of residence. <br /> FINDING OF FACT: <br /> 1. Cul-de-sac constructed with 75 foot radius while 60 foot radius is <br /> standard. <br /> 2. Proposed setback will keep consistent distance from blacktop with <br /> adjoining conforming residence. <br /> 3. Septic area and slope of land limit buildable area. <br /> CONCLUSION: <br /> 1. Variance is necessary to provide right enjoyed by others. <br /> 2. Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Carried 4-0. <br /> #1767. Jones/Quackenbush to hold in abeyance until 10/27/88 public hearing <br /> pending board viewing property on next inspection trip. <br /> Carried 4-0. <br /> #1768. Rendall/Quackenbush to grant variance of 12 feet plus or minus from <br /> required read year to permit addition to existing residence. <br /> FINDING OF FACT: <br /> 1. Rear of property is bounded by vacant agricultural lands. <br /> 2. Buildable area limited by location of existing residence on lot, septic <br /> and terrain. <br /> CONCLUSION: <br /> 1. Variance is not contrary to rights of others or to the public interest. <br /> Carried 4-0. <br />
