Quackenbush/Jones to grant variance of 8 feet plus or minus from <br /> required left side yard to permit construction of residence garage. <br /> FINDING OF FACT: <br /> 1. Setback from road is addressed in Appeal #1704. <br /> 2. No objection from neighbor most affected. <br /> 3. New structure will be 0.5 foot further from lot line than existing <br /> building. <br /> CONCLUSION: <br /> 1. Variance is necessary to provide right enjoyed by others. <br /> 2. Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Carried 4-0 <br /> #1773. Jones/Quackenbush to grant variance of 5 feet from required left <br /> sideyard to permit garage addition to existing residence. Also to deny <br /> variance from required right sideyard for second story addition. <br /> FINDING OF FACT: <br /> 1. Left side neighbor registered no objection while right side neighbor <br /> objects to encroachment. <br /> 2. Garage addition to left side is offset with neighbor, however second story <br /> would over shadow right side neighbor whose house is alongside. <br /> 3. Variances to both sides would eliminate access to lake front by emergency <br /> vehicles. <br /> CONCLUSION: <br /> 1. LEFT SIDE: Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 2. LEFT SIDE: Variance is not contrary to rights of others or to the public <br /> interest. <br /> 3. RIGHT SIDE: Unnecessary hardship was not proven. <br /> Carried 4-0. <br /> PETITIONS FROM PREVIOUS HEARINGS <br /> #1656. Quackenbush/Jones to grant with conditions special exception permit <br /> extension until November 1, 1988 to permit completion of landscaping and <br /> retaining walls. <br /> CONDITIONS: <br /> Erosion control plan be drafted and strictly adhered to within 2 weeks. <br /> Carried 4-0. <br /> #1661. Quackenbush/Jones to hold in abeyance until October 27, 1988 public <br /> hearing upon request of applicant. <br /> Carried 4-0. <br /> #1678.
