Quackenbush/Jones to grant variance of 25 feet from minimum required <br /> setback from right-of-way CTH "AB" to permit construction of residence <br /> garage. Also grant variance of 35 feet more or less from required <br /> right-of-way setback to permit deck addition to residence which will not <br /> extend beyond residence by more than 8.5 feet excluding steps. <br /> FINDING OF FACT: <br /> 1. Applicant and County Highway Dept. reached agreement on setback. <br /> 2. Sideyard variance #1772 granted. <br /> 3. Deck is entryway/exist to that side of residence. <br /> CONCLUSION: <br /> 1. Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2. Variance is not contrary to rights of others or to the public interest. <br /> Carried 4-0. <br /> #1736. Quackenbush/Jones to grant variance of 241 feet more or less from <br /> centerline Carver Street. Also 231 feet plus or minus centerline CTH "D" (Fish <br /> Hatchery Road) to permit directory sign. <br /> FINDING OF FACT: <br /> 1. Sign shall be minimum of 26 feet South of right-of-way - Carver Street and <br /> 14 feet West right-of-way CTH"D". <br /> 2. County Highway Dept. has no objection to proposed location. <br /> CONCLUSION: <br /> 1. Variance preserves the zoning ordinance as much as possible without <br /> Cre injustice to applicant. <br /> 2. Variance is not contrary to rights of others or to the public interest. <br /> Carried 4-0. <br /> 1750. Quackenbush/Jones to grant with conditions special exception permit for <br /> fill and grade lot for drainage away from existing residences. <br /> CONDITIONS: <br /> 1. Subject to work being done as per plan as submitted by Sarko Engineering. <br /> 2. Subject implementation of erosion control measures. <br /> 3. That there be filed with Zoning Department a certificate of compliance by <br /> a licensed engineering at the completion of the project. <br /> FINDING OF FACT: <br /> 1. Project proposes gradual slope of land providing drainage into marsh. <br /> 2. The property slopes inward and water sets in center of lots. <br /> 3. Fill material is from public sewer excavation in area. <br /> CONCLUSION: <br /> 1. The project as planned with specified conditions will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Carried 4-0 <br /> #1751. Quackenbush/Jones to grant variance of 10 feet from required setback <br /> to right-of-way of Tall Oaks Road to permit construction of new single family <br /> residence. <br /> FINDING OF FACT: <br /> OP 1. Property has extreme slope away from road. <br /> 2. Adjoining property owner has removed his objection. <br /> CONCLUSION: <br /> 1. Proven case of unnecessary hardship. <br /> 2. Variance is necessary to provide right enjoyed by others. <br /> Carried 4-0. <br />
