The filling as exists has a "dam effect" an causes water to back up flooding the area during spring thaw. 3). New owner purchased property and inherited violations. CONCLUSION: 1). The project as planned, with specified conditions; will not result in substantial detriment to navigable waters by erosion, sedimentation, impairment of fish or aquatic life, or safe and healthful conditions. Farnsworth Quackenbush/Kruschke to grant permit, with conditions, to fill/grade to ensure proper drainage of run-off after residential construction. CONDITIONS: 1). That work along East property line be completed as follows: a). Drain tile from a point on property line that begins 60 feet Southerly of B.M. (iron spike in P.P. at Northeast corner of lot shown on site plan T & C Services dated (12/20/90) and runs to the lake be installed by April 15, 1991. b). That "Aco self Rain Drain" drainage system be installed along East property line commencing at B.M. (iron spike in P.P. at Northeast corner of lot shown on site plan "T & C Services dated 12-20-90) and ending 60 feet Southeasterly along property line by March 1, 1991. *2). Aforementioned underground drainageways to be located entirely on applicant's property with "ACO" Drain System being not further than 2 feet from property line and drain tile (extending towards lake) not further than 1 foot from common lot line between Lot #25 and 26. 3). Permit is specifically limited to "Aco Self Rain Drain" drainage system or equivalent product specifically approved by Mead and Hunt. 4). That there certification upon completion by a Registered Professional Engineer that project completed within guidelines of plans submitted and conditions. FINDING OF FACT: 1). Permit is to correct drainage problems after construction of new residence. 2). Neighbors have reached tentative accord regarding plan approval. 3). By implementing drain system by deadlines spring thaws may cause minimal erosion. CONCLUSION: 1). The project as planned, with specified conditions; will not result in substantial detriment to navigable waters by erosion, sedimentation, impairment of fish or aquatic life, or safe and healthful conditions.
