Right-of-way curves into property and setback was miscalculated. <br /> 1 3) . Adjoining garage is as close or closer. <br /> 4) . Fill and grade was spreading of excavated materials and addition to <br /> topsoils. <br /> CONCLUSION: <br /> 1) . Variance is necessary to provide right enjoyed by others. <br /> 2) . The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> 3) . The project as planned with specified conditions will preserve the <br /> natural shoreline. <br /> Motion carried - 5-0. <br /> #1984. Appeal by Howard Lien & Sons, Inc. for a variance from required <br /> setback from road as provided by Section 10.17 (3) to permit addition to <br /> existing residence at 2466 Clearview Road in the NW 1/4 SW 1/4 - Section 14, <br /> Town of Christiana. <br /> IN FAVOR: S. Lien OPPOSED: --- COMMUNICATION: Environmental Health <br /> Jones/Rendall to grant variance of 9 more or less feet from required setback <br />' to centerline Clearview Road to permit porch addition to existing residence.CV FINDING OF FACT: <br /> 1) . Request is for renewal of Variance #1630 which has expired. <br /> 2) . Addition will extend no nearer to road than does existing residence. <br /> 3) . Addition is enclosure from elements for elderly relative. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the public interest. <br /> 2) . That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2) .
