Mapes - Dunn. <br /> Harvey/Rendall to grant variance of 4 more or less feet from required right <br /> sideyard to permit 22' x 24' addition to existing residence. <br /> FINDING OF FACT: <br /> 1) . Addition will extend existing building line of residence. <br /> 2) . Applicant has acquired an additional 5 foot of lot width at road thru <br /> vacation of lands not claimed between 2 platted subdivisions. <br /> 3) . Adjoining neighbors have submitted letters approving request. <br /> 4) . Property is in an area of numerous non-conforming structures and an area <br /> with numerous variances. <br /> CONCLUSION: <br /> 1) . Variance is necessary to provide right enjoyed by others. <br /> 2) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 4-0. <br /> #1962. McNeilly - Dunn. <br /> Quackenbush/Rendall to hold in abeyance until May Hearing to allow applicant <br /> to research alternative plans with designer. <br /> Motion carried - 4-0. <br /> Coy #1963. Dietrich - Springdale. <br /> Harvey/Quackenbush to grant, with condition, variance of 7 more or less feet <br /> from required setback to centerline of Malone Road to permit porch <br /> reconstruction. <br /> CONDITION: <br /> 1) . Proposed porch shall extend no nearer required setback than did previous <br /> porch in need of repair. <br /> FINDING OF FACT: <br /> Existing porch not salvagable due to extensive rotting. <br /> 2) . Town Board has no objection. <br /> CONCLUSION: <br /> 1) . Variance is contrary to rights of others or to the public interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 4-0. <br /> #1964. Volden - Perry. <br /> Harvey/Rendall to grant, with condition, variance of 24 more or less feet from <br /> required setback to STH "78" to permit addition to existing residence. <br /> CONDITION: <br /> 1) . Variance is for second story enclosure entirely over existing lower level. <br /> FINDING OF FACT: <br /> 1) . Addition is intended to remove flat roof over kitchen in need of repair. <br /> 2) . Addition is intended as closet space for residence. <br /> 3) . Existing residence almost entirely within required setback as located. <br />
