Quackenbush/Harvey grant variance from the required setbqck from Bible <br /> Camp Road to allow garage to be constructed no closer to the road than <br /> the existing garage on the adjacent property to the left and South of <br /> the subject property. <br /> FINDING OF FACT: <br /> 1 . required setback from road and normal high water mark restrict the <br /> permitted building locations <br /> 2. several setback variances have been granted in this area because of <br /> the restrictive front and lake setbacks. <br /> CONCLUSION: <br /> 1 . proven case of unnecessary hardship. <br /> 2. variance is necessary to provide right enjoyed by others. <br /> 3. variance is not contrary to rights of others or to the public interest. <br /> Motion carried 4-0. <br /> 1953. Harvey/Quackenbush hold in abeyance for 30 days to provide time to <br /> review assurences that the multifamily use will be for the elderly; <br /> motion carried 4-0. <br /> 1954. Quackenbush/Harvey approve special exception permit as proposed; <br /> CONDITION: Certification from a professional engineer that the <br /> project complies with the shoreland regulations and has <br /> been completed as specified shall be submitted to Dane <br /> County Zoning. <br /> Motion carried 4-0. <br /> 1955 . Quackenbush/Jones grant a variance of 2.7 ft. more or less, from the <br /> required left side yard; <br /> CONDITION: foundation may not project farther out than the existing <br /> wall of the building. <br /> FINDING OF FACT: <br /> 1 . existing residence encroaches into the required side yard and cannot be <br /> moved to provide compliance. <br /> 2. existing foundation is only a partial crawl space. A full foundation <br /> will provide structural integrity for the residence. <br /> 3. further encroachment is not allowed into side yard. <br /> CONCLUSION: <br /> 1 . proven case of unnecessary hardship. <br /> 2. variance is necessary to provide right enjoyed by others. <br /> 3. variance is not contrary to rights of others or to the public interest. <br /> Motion carried 4-0. <br /> 1956. Jones/Harvey grant variance of 19 ft, more or less, from the required <br /> setback from Box Elder Road. <br /> FINDING OF FACT: <br /> 1 . milkhouse drainfield at back of shed prevents addition in that area. <br /> 2. existing barn to the left projects closer to the road than the proposed <br /> addition to the shed. <br />
