Zerbe - Dunn. <br /> Quackenbush/Jones to deny requested variance from left sideyard to permit deck <br /> encroachment as constructed. <br /> FINDING OF FACT: <br /> 1) . Applicant was aware of required yards and requirement so noted on permit. <br /> 2) . Applicant is owner/builder and errored in foundation location. <br /> 3) . A narrowed deck in complying location will achieve desired results and be <br /> functional. <br /> CONCLUSION: <br /> 1) . Unnecessary hardship was not proven. Motion carried - 4-0. <br /> #1939. Burns - Montrose. <br /> Harvey/Quackenbush to grant variance of 17 more or less feet from required <br /> setback to right-of-way of Sun Valley Parkway to Permit converting existing <br /> deck to enclosed porch. <br /> FINDING OF FACT: <br /> 1) . Deck built under Variance #206, granted in 1972 and applicant wishes to <br /> roof over and enclose. <br /> 2) . Existing residence extends further into setback than proposed project. <br /> 3) . No objection was received. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the public interest. <br /> 2) . Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 4-0. <br /> #1940. Rhodes - Dunn. <br /> Quackbenbush/Harvey to grant, with condition, variance of 5.8 more or less <br /> feet from required setback to normal high watermark to permit foundation under <br /> existing residence. <br /> CONDITION: <br /> 1) . There shall be no further encroachment toward normal high watermark than <br /> existing building line. <br /> FINDING OF FACT: <br /> 1) . Foundation will not extend nearer normal high watermark than already <br /> exists. <br /> 2) . Foundation is intended to stabilize existing residence and prevent <br /> rotting and rodent infestation. <br />
