Paule - Dunn. <br /> Quackenbush/Harvey to grant; variance of 4.9 more or less feet from required <br /> sideyard for construction of bilco door, variance of 0.4 more or less foot <br /> from required sideyard to permit addition to existing storage building as <br /> constructed. Variance of 9 more or less feet from required setback to <br /> right-of-way of Quam Point Drive to permit construction of residential garage <br /> addition to residence. Also, to hold until February 22nd hearing requested <br /> sideyard variance for garage construction. <br /> FINDING OF FACT: <br /> 1) . Shed had earlier variance for location and was added to without permit by <br /> previous owner. <br /> 2) . Lot is pie-shaped with steep drop towards lake. <br /> 3) . Residence has no basement and existing single car garage being utilized <br /> for storage. <br /> CONCLUSION: <br /> 1) . Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> 2) . Variance is necessary to provide right enjoyed by others. <br /> 3) . Abeyance will allow applicant time to consider alternative design or <br /> modification to plan regarding sideyard of proposed garage. <br /> Motion carried - 4-0. <br /> #1943. Haskins - Dunn. <br /> Quackenbush/Harvey to deny requested sideyard variance to permit accessory <br /> building as located. <br /> FINDING OF FACT: <br /> 1) . Structure recently constructed without zoning permit too near side lot <br /> line. <br /> 2) . Neighbor has similarly located structure, however been so located 20+ <br /> years and deemed non-conforming by Zoning Administrator. <br /> 3) . Structure has no foundation and location difficulty can be remedied. <br /> CONCLUSION: <br /> 1) . Unnecessary hardship was not proven. <br /> Motion carried - 4-0. <br /> #1944.
