Subject to approval by adjoining right side property owner. <br /> 2). All approvals subject to preliminary map by Fred Thomack; RLS dated <br /> 8/26/92. <br /> 3). That there be recorded a certified survey map identical to map eluded to <br /> in Condition #2. <br /> FINDING OF FACT: <br /> 1). Variance #646 granted March 1976 allowed garage 4.5 feet from right <br /> sideyard. <br /> 2). Recent property survey disclosed garage actually constructed 1.4 feet <br /> across right side line. <br /> 3). Proposal is to equally adjust lot line between adjoining owners to <br /> re-instate earlier granted 5.5 foot variance. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 3-0. <br /> #2281. Appeal by Mark Gerhardt, agent for Joe Kalschuer, Jr.for a variance <br /> from required location of accessory buildings for livestock as provided by <br /> Section 10.123(7) to permit accessory building for livestock after lot <br /> division at 6918 Fischer Road in the NE 1/4 SE 1/4 - Section 22, Town of <br /> Springfield. <br /> IN FAVOR: M. Gerhardt, J. Kalschuer <br /> Dreps/Lynch to grant variance of 92.4 feet from required distance between farm <br /> accessory building for the housing of livestock and a residential zoned lands. <br /> FINDING OF FACT: <br /> 1). Proposal is to divide existing residence from farm for use by farm owner <br /> to accommodate sale of balance of lands to son. <br /> 2). Configuration of lands and necessity to have 20,000 square feet of lot <br /> area bring zoned area with 7.6 feet of existing barn. <br /> 3). Similar variance approved in Town of Cottage Grove which allowed <br /> Ag-building for housing of livestock within 95 more or less feet of residence <br /> while actual distance between residence and barn is 150 foot plus. <br /> 4). Appears intent of Ordinance is to prohibit construction of farm <br /> buildings, for keeping of livestock, too near to residential properties. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 2-1. (Gaskill, no) <br /> #2273. Appeal by City of Madison for a variance from required setback from <br /> road as provided by Section 10.17(3) to permti canopy construction over <br /> existing tanks at 902 Wheeler Road in the SW 1/4 SW 1/4 - Section 24, Town of <br /> Westport. <br /> No appearances. <br /> Gaskill/Lynch to hold appeal in abeyance until September Hearing at request of <br /> applicant, to allow further negotiation with Township. Motion carried - 3-0. <br />
