BOA MINUTES 11/20/97 <br /> Page 3 <br /> 3) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> approvals. <br /> 5) . Inspection and approval by Zoning Department upon <br /> completion of project. <br /> 6) . At the discretion of the Board of Adjustment, <br /> inspection and approval by the Zoning Department during <br /> and/or upon completion may be required. <br /> 7) . Permit valid November 20, 1997 with completion and <br /> certification deadline of December 30, 1997 if work <br /> commences in 1997 or valid April 1, 1998 with completion and <br /> certification deadline of May 1, 1998 if project delayed <br /> until Spring. <br /> Finding of Fact: <br /> 1) . Existing single 20 foot culvert to be replaced by (2) <br /> 50 foot culverts to accommodate farm machinery crossing. <br /> 2) . Culverts to be installed on bed of Sugar River and <br /> Special Exception Permit to allow approaches to crossing on <br /> either side. <br /> 3) . Subject property has previous Special Exception Permit <br /> for installation of drain tile with ultimate connection to <br /> Sugar River. <br /> 4) . Applicant has received Chapter 30 from Wisconsin <br /> Department of Natural Resources and Army Corps <br /> authorizations . <br /> 5) . Engineering plans and specifications provided by <br /> Laurence Schmit, Professional Engineer. <br /> Conclusion: <br /> 1) . The project as planned, with specified conditions; will <br /> not result in substantial detriment to navigable waters by <br /> erosion, sedimentation, impairment of fish or aquatic life, <br /> or safe and healthful conditions. Motion carried - 5-0. <br /> #2891 . Appeal by Mariner Real Estate, LLC for a Special <br /> Exception Permit as provided by Section 11 . 05 (3) to permit <br /> filling, grading, etc. , within 300 feet of Yahara River <br /> located at 5339 Lighthouse Bay Drive in the SE 1/4 SE 1/4 - <br /> Section 22, Town of Westport. <br /> IN FAVOR: R. Klaas, K. Clark, J. Von Rutenberg, B. Von <br /> Rutenberg OPPOSED: --- COMMUNICATION: Town Board, <br /> Regional Planning Commission. <br /> KLOPP/KLUESNER to grant, with conditions, permit to fill and <br /> grade to allow for lot drainage after building addition and <br /> parking lot construction. <br /> Conditions : <br /> 1) . That the last 2 parking stalls (nearest the lake) be <br /> deleted from the plan to provide for stockpiles of snow. <br />
