Appeal by William & Darlene Chambers for a variance from <br /> required setback from road as provided by Sections <br /> 10. 16 (5) to permit in-ground swim pool as constructed at <br /> 5886 Winchester Avenue being Lot #23 , Drover ' s Woods - <br /> Section 12 , Town of Sun Prairie. <br /> IN FAVOR: W. Chambers OPPOSED: --- COMMUNICATION: Environmental <br /> Health, Town Board <br /> Klopp/Lynch to grant with condition, variance of 7 . 25 feet from <br /> required reduced setback to Prospector Lane to permit in-ground <br /> swimming pool as constructed. <br /> CONDITION: <br /> That if either 50% of the physical structure or 50% of the assessed <br /> value of the pool is exceeded during repair or replacement it shall <br /> be relocated to a complying location. <br /> FINDING OF FACT: <br /> 1. Pool constructed by original home owner, prior to applicants <br /> acquiring property (applicant being third owner) . <br /> 2 . Pool is surrounded by high fencing and is not visible to <br /> public. <br /> 3 . Pool is approximately 18 years old in its present location. <br /> 4 . Prior to 1970 permits were not required by Dane County. <br /> 5 . Similar variances have been granted. <br />
