During all phases of project that erosion control measures be <br /> in place. <br /> FINDING OF FACT: <br /> 1) . Project offers a minimal disturbing activity and utilizes <br /> erosion control. <br /> 2) . Disturbed areas have relatively flat grassed expanses to <br /> filter before reaching the lake. <br /> 3) . A privacy and sound barrier/earthen berm to be constructed <br /> along East property line. <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will not <br /> result in substantial detriment to navigable waters by erosion, <br /> sedimentation, impairment of fish or aquatic life, or safe and <br /> healthful conditions. <br /> Motion carried - 5-0. <br /> #2435. Appeal by Arlan Kay, agent for James Crowley for a Special <br /> Exception Permit as provided by Section 11. 05 (3) to permit filling, <br /> grading, etc. , within 300 feet of Lake Waubesa at 4292 Jordan Drive <br /> being Lot #14 , Block 1, Brictson Park - Section 8 , Town of Dunn. <br /> IN FAVOR: J. Crowley OPPOSED: --- COMMUNICATION: Town Board <br /> (Combined with #2423 , July 22 , 1993 P.H. <br /> ................................................. <br /> #2423 . DREPS/GASKILL to grant a variance of 6 feet 2 inches to <br /> ............................................ <br /> maximum allowable height, of boathouse, above normal high water <br /> mark to permit boathouse has proposed. <br /> FINDING OF FACT: <br /> 1) . Floor of boathouse presently 3 feet above normal high <br /> watermark as poured. <br /> 2) . Additional height utilized for needed overhead door dimension. <br /> 3) . As approved, top of boathouse will be slightly below existing <br /> grade of yard. <br /> 4) . Adjoining owner, also set into steep bank, granted larger <br /> Variance (1745 8-88) . <br /> 5) . Bank stabilization (Special Exception #2435) incorporated into <br /> project. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> Car 2) . Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 5-0. <br />
