Roethe, R & G Waltz OPPOSED: --- <br /> COMMUNICATION: --- <br /> Gaskill/Klopp to grant variances from required lot width, lot area, sideyard <br /> and sideyard for accessory building to allow lotline adjustment between <br /> property owners with structures existing. <br /> FINDING OF FACT: <br /> I ). Approvals are based upon submittal information, which is an Arden <br /> Sandsness survey dated 5/21/92. <br /> 2). Buildings and structures are pre-existing. <br /> 3). Variances necessitated by certified survey map requirement for land <br /> transaction within recorded plat. <br /> 4). Both effected property owners in favor. <br /> 5). Erroneous survey (CSM 5815) showed incorrect lot line and house in <br /> complying location. <br /> CONCLUSION: <br /> I ). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 3-0. <br /> #2391 . Appeal by Robert and Karen Vick for a variance from required setback <br /> from road and required sideyard as provided by Sections 10.17(4) and <br /> 10.11 (7)(a) to permit storage building as constructed at 3097 Sunnyside Street <br /> being Lot #30 and 31 , Block #1 , Addition to Lee 's Park - Section 18, Town of <br /> Pleasant Springs. <br /> IN FAVOR: K. Vick OPPOSED: --- COMMUNICATION: --- <br /> Gaskill/Klopp to grant variance of 16 more or less feet from required setback <br /> to right-of-way of Sunnyside Street also to grant a variance of 10 feet from <br /> required sideyards to permit accessory building as constructed. <br /> FINDING OF FACT: <br /> I ). Structure was nonconforming to which lean-to addition was re-roofed and <br /> enclosed. <br /> 2). Sideyard variance impact is negligible as applicant owns both lots and <br /> simply has constructed across common lot line. <br />
