Engineering provided by Mark Von Drasek Professional <br /> Engineer, Mayo Corporation. <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will <br /> not result in substantial detriment to navigable waters by <br /> erosion, sedimentation, impairment of fish or aquatic life, <br /> or safe and healthful conditions. Motion carried 5-0. <br /> #2771 . Appeal by William and Sharon Way for a variance from <br /> required setback from road as provided by Section 10. 17 (1) <br /> to permit deck addition to existing residence at 1725 STH 92 <br /> being Lots 9, 10 and N 1/2 Lot #8, Block #26, Mount Vernon, <br /> Byam' s Addition, Section 34, Town of Springdale. <br /> IN FAVOR: S . Way OPPOSED: --- COMMUNICATION: Town Board <br /> KAY/GASKILL to grant variance of 14 . 3± feet from required <br /> setback to centerline of STH 92 to permit residential <br /> addition as proposed. <br /> FINDING OF FACT: <br /> 1) . Existing residence is presently within required <br /> setback. <br /> 2) . Residence is approximately 100 years old. <br /> 3) . Deck and screen room is behind residence and side and <br /> rearyard location complying. <br /> 4) . Property is in an area of numerous nonconforming <br /> structures with numerous nonconforming variances granted. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest . Motion carried - 5-0 . <br /> #2772 . Appeal by Herman and Nancy Wipperfurth for a <br /> variance from required number of parking spaces as provided <br /> by Section 10. 18 (4) to permit expansion of tavern patron <br /> area and also for a Special Exception Permit as provided by <br /> Section 11 . 05 (3) to permit filling, grading, etc. , within <br /> 300 feet of tributary to Lake Mendota - located at 5485 <br /> Willow Road in the SW 1/4 SW 1/4 Section 22, Town of <br /> Westport. <br /> IN FAVOR: C. Gombar, H. Wipperfurth OPPOSED: --- <br /> COMMUNICATION: Regional Planning Commission, Town Board <br /> GASKILL/SAYLES to hold request in abeyance until October <br /> Public Hearing to allow applicant to submit alternative <br /> proposals .
