Appeal by John Tiefel for a variance from required setback from normal high watermark and sideyard as provided by Sections 11 . 03 (2) and 10. 06 (7) to permit deck addition to existing residence as constructed at 2054 Barber Drive, being Lot #1, CSM #8298 in the NE 1/4 NW 1/4, Section 26, Town of Dunn. IN FAVOR: J. Tiefel OPPOSED: --- COMMUNICATION: Town Board GASKILL/KAY to deny requested sideyard variance as proposed. FINDING OF FACT: 1) . Applicant constructed 6 x 12 deck addition from upper level patio doors without required permits . 2) . Variance #2202 on November 21, 1991 granted setback from normal high watermark but denied any variance from right sideyard to permit deck construction. 3) . Applicant appears to have ample emergency exits or with design change can achieve desired access . CONCLUSION: 1) . Unnecessary hardship was not proven. Motion carried 3-2 . (Klopp and Sayles, no) . #2775. Appeal by Lake Kegonsa Sanitary District for a Special Exception Permit as provided by Section 11 . 05 (3) to permit filling, grading, etc. , within 300 feet of Lake Kegonsa located at Southeast corner USH 51 and CTH AB - in the NE 1/4 SW 1/4 - Section 23, Town of Dunn. IN FAVOR: J. Jenkins OPPOSED: --- COMMUNICATION: Town Board, County Highway GASKILL/SAYLES grant with conditions permit to fill and grade to alleviate flooding difficulties as proposed. CONDITIONS: 1) . That plans and specifications be prepared by a licensed engineer within the scope of the application, and filed with the Zoning Department before commencement of any work. 2) . That all work be performed in compliance with approved engineering standards and all applicable governmental rules and regulations particularly Section 11 . 05 (4) of Dane County Code of Ordinances . 3) . That there be filed with the Zoning Department a Certificate of compliance by a licensed engineer at the completion of the project. L
