Appeal by Darrell and Angela Holcomb for a variance from required sideyard as provided by Section 10 . 07 (7) to permit single family residence as constructed at 118 Maple Street being Lots 12 and 13, Block 9, Edgerton Beach Park - Section 25, Town of Albion. IN FAVOR: S . Perkins OPPOSED: --- COMMUNICATION: Town Board SAYLES/GASKILL to deny requested variance from left sideyard to permit residence as constructed. FINDING OF FACT: 1) . New residence (ZP 1996 1308) was constructed in violation of required 10 foot minimum sideyard. 2) . Residence slightly askew on lot and sideyard encroachment extends a distance of 16± feet. 3) . A requested transfer of land between adjoining owners was halted, but may Have to be re-initiated. 4) . No similar variances in immediate area. CONCLUSION: 1) . Unnecessary hardship was not proven. Motion carried - 4-0 . #2765. Appeal by ANR Pipeline Company, agent for various owners for a Special Exception Permit as provided by Section 11 . 05 (3) to permit filling, grading, etc. , within 300 feet of Koshkonong Creek located in the various 1/4' s 1/4' s - Sections 19 and 20, Town of Sun Prairie and Section 36, Town of Burke . IN FAVOR: T. Field, S . Taipala, R. Rivard OPPOSED: --- COMMUNICATION: County Highway, Regional Planning Commission GASKILL/SAYLES to hold request until September Hearing to allow applicant to provide additional information. Motion carried - 4-0 . #2766 . Appeal by Richard and Amy Krumenauer for a Special Exception Permit as provided by Section 11 . 05 (3) to permit filling, grading, etc. , within 300 feet of tributary to Blums Creek located at 7151 Kippley Road in the NW 1/4 NW 1/4 of Section 21, Town of Roxbury. IN FAVOR: R. Krumenauer OPPOSED: --- COMMUNICATION: - GASKILL/KLOPP to grant with conditions fill and grade request for landscape and lot drainage after construction of new residence.
