BOA MINUTES 8/22/96 <br /> Page 3 <br /> C <br /> CONDITIONS: <br /> 1) . That existing silt fencing be property installed and <br /> maintained. <br /> 2) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with <br /> the Zoning Department before commencement of any work. <br /> 3) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules <br /> and regulations particularly Section 11 . 05 (4) of Dane County <br /> Code of Ordinances . <br /> 4) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project . <br /> 5) . Subject to all other necessary governmental agency <br /> approvals . <br /> 6) . Inspection and approval by Zoning Department upon <br /> completion of project. <br /> 7) . Completion and certification deadline of September 15, <br /> 1996 for yard work and from May 15, 1997 thru June 15, 1997 <br /> for retaining walls if intended to be installed. <br /> FINDING OF FACT: <br /> 1) . Fill was placed on property without required permits . <br /> 2) . Filled area is within 300 feet of a tributary of Blums <br /> Creek. <br /> 3) . Applicant hit high ground water while excavating for <br /> basement and was forced to construct further above grade <br /> thereby necessitating additional fill material . <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; <br /> will not result in substantial detriment to navigable waters <br /> by erosion, sedimentation, impairment of fish or aquatic <br /> life, or safe and healthful conditions . Motion carried - <br /> 4-0 . <br /> #2767 . Appeal by Joseph Goodwin for a variance from <br /> required sideyard as provided by Section 10 . 123 (7) and <br /> 10 . 05 (7) to permit garage addition to existing residence at <br /> 5356 Bong Road in the SW 1/4 SE 1/4 - Section 10, Town of <br /> Westport . <br /> IN FAVOR: D. Zastrow OPPOSED: P. Fahrni COMMUNICATION: <br /> Town Board <br /> GASKILL/KLOPP to deny requested variance from required left <br /> sideyard to permit addition to residence garage as proposed. <br /> C <br />
