Appeal by Myron Pozniak and Kathleen Baus for a <br /> variance from required setback from normal high watermark as <br /> provided by Section 11 . 03 (2) to permit addition to existing <br /> residence at 5561 Kupfer Road being Lot #1, CSM 5322 in the <br /> SE 1/4 NE 1/4 - Section 28, Town of Westport. <br /> IN FAVOR: M. Pozniak OPPOSED: --- COMMUNICATION: <br /> D.N.R. , Town Board <br /> GASKILL/SAYLES to grant with conditions variance not to <br /> exceed 2 feet from required setback to normal high watermark <br /> of Lake Mendota for a distance not exceeding 12 .5 lineal <br /> feet to permit addition to existing residence. <br /> CONDITION: <br /> 1) . That addition remain screen porch and not become fully <br /> enclosed thereby reducing neighbors view of lake. <br /> 2) . Steps be relocated as not to further encroach beyond <br /> limit of variance grant of 2 feet or less . <br /> FINDING OF FACT: <br /> 1) . Application is a re-apply of earlier denial (#2671) to <br /> which surveyor verification minimized variance needed. <br /> 2) . Varianced area amounts to less than 11 square feet. <br /> 3) . Proposed addition visually aligns with adjoining <br /> structures; however, irregular shoreline necessitates <br /> Variance. <br /> 4) . Modest porch/deck extending 10 feet from residence is <br /> consistant with similar approvals . <br /> CONCLUSION: <br /> 1) . Variance preserves the Zoning Ordinance as much as <br /> possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. Motion carried - 4-0 <br /> #2717 . Appeal by Tom McClintock et al . for a variance from <br /> required setback from road as provided by Sections 10 . 17 (4) <br /> and 10. 16 (5) to permit additions to existing duplex as <br /> constructed at 1704-06 Martin Street being Lots 14 and 15, <br /> Block #8, Lake Forest Plat - Section 34, Town of Madison. <br /> IN FAVOR: T. McClintock, K. Schmerler OPPOSED: --- <br /> COMMUNICATION: --- <br /> SAYLES/KLOPP to grant Variance of 3 .25 feet± from required <br /> setback to Martin Street to permit entry deck and steps as <br /> constructed. Motion carried - 4-0. <br /> SAYLES/KLOPP to hold in abeyance any requested Variance to <br /> setback from Dunn Place until the April `96 Hearing. Motion <br /> carried - 4-0. <br /> FINDING OF FACT: <br /> 1) . Martin Street Variance is a re-request of previously <br /> approved Appeal (#2508 - 5/26/94 P.H. ) to which a zoning <br /> Permit not obtained. <br /> (my 2) . Previous owner built entry over existing concrete <br /> steps/stoop without County Zoning Permit. <br />
